641 proper and necessary And in the next Place upon Trust to pay and allow unto him the said John Buchanan yearly and every Year for and during and unto the full End and Term of five Years to be computed from the Day of the Date thereof In Case he the said John Buchanan should so long happen to live the annual Sum of five hundred pounds for and towards the Support of himself and Family and in Case the said John Buchanan should happen to depart this Life at any Time before the End and Expiration of the said Term of five Years Then upon Trust to pay and allow unto the Wife of the said John Buchanan yearly and every Year for and during all the Residue and Remainder which should be then to come and unexpired of the said Term of five Years the annual Sum of four hundred Pounds for and towards the Support and Maintenance of herself and Family And in Case both of them the said John Buchanan and Elizabeth his Wife should happen to depart this Life before the End and Expiration of the said Term of five Years Then upon Trust to pay and allow unto the Children of the said John Buchanan who should be then living for all the Residue and Remainder which should be then to come and unexpired of the said Term of five Years at the Time of the Decease of the Survivor of them the said John Buchanan and his Wife the annual Sum of three hundred Pounds for and towards their Support and Maintenance and after making such several Payments as aforesaid Then upon Trust to retain pay and divide all such Monies as they or any of them should receive by Virtue thereof to themselves and amongst the Creditors executing the said Indenture in equal Proportions according to their respective Debts and according to the Estate or Estates upon which they should respectively be Creditors and the Account of such Estate or Estates respectively together with Interest after the Rate of five Pounds per Cent upon all such Debts respectively from y.e Time the same should respectively become due and payable such Time of Payment being allowed to be at the End of fifteen Months from the Time of the Delivery of the Goods for which such Debts had incurred And in Case the Effects thereby assigned should amount to more than should be sufficient to discharge all the said Creditors Debts and the Charges relating thereto Then upon Trust to pay the Residue to the said John Buchanan his Exors or Admors as in and by the said in part recited Indenture Relation being thereunto had more at large may appear And whereas the said John Buchanan was at the Time of the Execution of the said in part recited Indenture and now is seized of the absolute Estate of Inheritance in Fee Simple in Possession of and in one undivided third part of a certain freehold Estate commonly called or known by the Name of Nottingham Iron Works situate and being in the Province of Maryland in North America with (the) |
