640 the rest of the joint and seperate Creditors of the said John Buchanan and Gilbert Buchanan had agreed to accept in Satisfaction of their Debts and to give unto the said John Buchanan and Gilbert Buchanan such general Releases as thereinafter are mentioned subject also to such Provisoes and Agreements as are herein after contained It was and is witnessed that in Consideration of the Premisses and in Pursuance of the said Proposal and of the Sum of five Shillings apiece of lawful Money of Great Britain to them the said John Buchanan and Gilbert Buchanan in Hand paid by the said John Rogers Abraham Dyson Richard Cooke John Worrall Edmund Lardner Samuel Dyson Edward Gale and Thomas Porteus They the said John Buchananan and Gilbert Buchanan as well in their Copartnership as in their respective seperate Capacities Did assign unto the said John Rogers Abraham Dyson Richard Cooke John Worrall Edmund Lardner Samuel Dyson Edward Gale and Thomas Porteus their Exors Admors and Assigns All the ready Money Notes Bills Goods Chattle Books of Account and personal Estate and Effects whatsoever and wheresoever of them the said John Buchanan and Gilbert Buchanan as Copartners of either of them in their respective seperate Capacities (the Wearing of Apparel of the said John Buchanan and his Family and also of the said Gilbert Buchanan and likewise the household Goods Furniture Plate Linnen China printed Books Wine and Liquors of the said John Buchanan only excepted) And also the Debts due owing and belonging to them the said John Buchanan and Gilbert Buchanan as Copartners or to either of them in their respective seperate Capacities from any Person or Persons whomsoever To have hold receive take and enjoy the same unto the said John Rogers Abraham Dyson Richard Cooke John Worrall Edmund Lardner Samuel Dyson Edward Gale and Thomas Porteus their Exors Admors and Assigns upon Trust in the first Place to pay all such Costs & Charges as they the said John Rogers Abraham Dyson Richard Cooke John Worrall Edmund Lardner Samuel Dyson Edward Gale and Thomas Porteus or any of them their or any of their Heirs Exors Admors or Assigns should pay suffer or be put unto in or about the executing the Trusts thereby in them or any of them reposed or otherwise relative thereto And after Payment thereof Then upon Trust to pay and discharge all such Bonds as should have been entred into by the said John Buchanan in his own seperate Capacity or by the said John and Gilbert Buchanan as Partners to his Majesty for Duties or otherwise and afterwards upon Trust to pay and discharge all or any such Bills as had been drawn or should be drawn on them the said John Buchanan and Gilbert Buchanan by any of their Correspondents in Maryland as they the said John Rogers Abraham Dyson Richard Cooke John Worrall Edmund Lardner Samuel Dyson Edward Gale and Thomas Porteus should think (proper) |
