602 whatsoever for the further better and more perfect conveying and Assuring the said hereby bargained and sold Lands and Premisses and every Part and Parcell thereof with the Appurtenances unto the said Thomas Sim Lee his Heirs and Assigns as by his or their Counsel learned in the Law shall be reasonably devised advised or required And lastly that in Case it shall at any Time hereafter appear upon an actual and accurate Survey of the said several Parcells of Land hereby bargained and sold do not collectively and in the whole contain four hundred Acres of Land that then and in ^such^ Case the said Judson Cooledge his Executors or Administrators shall and will repay and satisfy to him the said Thomas Sim Lee his Executors Administrators or Assigns at the rate of forty Shillings Sterling by the Acre with legal Interest for such Quantity of Land as the said several Parcells of Land hereby bargained and sold shall or may fall short of four hundred Acres of Land upon such actual and accurate Survey thereof as aforesaid In Witness whereof the Parties to these Presents have hereunto interchangeably set their Hands and affixed their Seals the Day and Year first above written Judson Cooledge (LS) Signed Sealed and Delivered in the Presence of us David Craufurd John Read Magruder On the Back of the aforegoing Deed was thus indorsed Viz.t Received on the Day and Year first above written of and from the within named Thomas Sim Lee the Sum of one thousand two hundred and sixty Pounds Sterling Money being the consideration Money in the aforegoing Instrument of Writing mentioned to be by him paid to me Received by me Witness Judson Cooledge David Craufurd 17 Sides John Read Magruder On the third Day of January in the Year Seventeen hundred and seventy four Came the above named Judson Cooledge before us the Subscribers two of the right Honourable the Lord Proprietary of Maryland his Justices of the Peace for Prince Georges County and acknowledged the aforegoing Instrument of Writing to be his Act and Deed and the Lands and Premisses therein mentioned and every Part and Parcell thereof with the Appurtenances to be the right and Estate of the within named Thomas Sim Lee his Heirs and Assigns for ever according to the true Intent and Meaning of the said Writing and the Act of Assembly in such Case made and provided David Craufurd John Read Magruder Feb.y 5.th 1774 Received of Thomas Sim Lee Esq.r Sixteen Shillings & four Pence three Farthings as Alienation Fines on the within lands Dan of S.t Tho.s Jenifer Recorded 11.th February 1774 Rec.r Gen.l |
