58 Walter Ewer John Ewer and John Buchanan all the Iron Ore Iron Mine & Iron Stone being in or upon any part or Parts of the said Tract of Land called Yates's Inheritance for which the said Recovery is suffered or mentioned to be suffered other and Except what thereof is within the said one hundred and thirteen Acre and an half Acre of Land being the Dwelling Plantation aforesaid herein before mentioned & Described with full and free Liberty and Priviledge to digg and Turn up the Earth and Soil to Search for raise and take away the said Iron Ore Iron Mine and Iron Stone and to make what necessary Drains they may think fit for that Purpose and also full and free Ingress Egress and Regress for their Servants Slaves Cattle and Carriages Employed in and about digging for raising taking and carrying away the same over and through such parts and such parts only of the said Tract of Land called Yates's Inheritance for which the said Recovery is suffered or mentioned to be suffered other than and not through the said Described one Hundred and thirteen Acres and an half Acre of Land To Have and to Hold one undivided third part of the said described one hundred Acres of Land with its Rights Members and Appurtenances and one undivided third part of the said Iron Ore Iron Mine and Iron Stone and one undivided third part of the said Liberties and Priviledges herein before granted or mentioned or intended so to be to him the said James Russell his Heirs and Assigns to the only proper use and behoof of him the said James Russell his Heirs and Assigns for ever and to or for no other use Intent or purpose whatsoever To have and to Hold one undivided sixth part of the said described one hundred Acres of Land with its Rights Members and Appurtenances and one undivided sixth part of the said Iron Oar Iron Mine and Iron Stone and one undivided sixth part of the said Liberties and Priviledges herein before granted or mentioned or intended so to be to him the said Walter Ewer his Heirs and Assigns to the only proper use and behoof of him the said Walter Ewer his Heirs and Assigns for ever and to or for no other use Intent or purpose whatsoever To have and to Hold one undivided sixth part of the said described one Hundred Acres of Land with its Rights Members and Appurtenances and one undivided sixth part of the said Iron Ore Iron Mine and Iron Stone and one undivided sixth part of the said Liberties and Priviledges herein before granted or mentioned or intended so to be to him the said John Ewer his Heirs and Assigns to the only proper use and behoof of him the said John Ewer his Heirs and Assigns forever and to or for no other use Intent or purpose whatsoever And to Have and to Hold the other undivided third part of the said Described one Hundred Acres of Land with its Rights (Members) |
