566 hereby further Covenants and agrees to and with the said Ely Gassaway his Heirs and Assigns that he the said Charles Dorsey and his Heirs shall and will at any Time or Times hereafter at the request and charge of him the said Ely Gassaway his Heirs or Assigns Execute any further Instrument or Instruments in Law that shall or may be found necessary for the more sure conveying and transferring the aforesaid Lands and Premisses unto the said Ely Gassaway his Heirs and Assigns for ever and finally the said Charles Dorsey for himself his Heirs Exectors and Administrators doth hereby covenant and agree to and with the said Ely Gassaway his Heirs and Assigns that he the said Charles Dorsey shall and will Warrant and for ever defend the Lands and Premisses aforesaid according to the Meets and Bounds aforesaid against all Persons claiming any Right Title or Interest thereto from by or under him the said Charles his Heirs Executors or Administrators In Testimony whereof the said Charles Dorsey hath hereunto set and affixed his Hand and Seal the Day and Year first above Written Signed Sealed and Delivered in the Presence of Cha.s Dorsey Son of Edw.d (LS) Upton Sheredine Ann Barnes On the Back of the aforegoing Deed was thus Endorsed Viz.t Received the 27.th Day of August 1773 from the within named Ely Gassaway the Sum of two hundred and Eight Pounds Current Money being the Consideration Sum within mentioned in full Satisfaction for the within Bargained Lands and Premisses as Witness my Hand Test Upton Sheredine Cha.s Dorsey Son of Edw.d Ann Barnes Maryland Frederick County On the 27 Day of August seventeen hundred and seventy three came before us the Subscribers Two of the Proprietarys Justices of the Peace for the County afs.d the within named Charles Dorsey and Acknowledged the within Instrument to be his Act and Deed and the Lands and Premisses therein mentioned to be the Right and Estate of the within named Ely Gassaway his Heirs and Assigns for ever And at the same Time personally appeared Lydia the Wife of the said Charles Dorsey who being privately examined out of the hearing of her said Husband relinquished her Right of Dower of in and to the within bargained Lands and Premisses and declared she did the same freely and voluntarily without any Threats from her said Husband or Fear of his displeasure Induc^i^ng her thereto according to the directions of an Act of Assembly in such case made and provided Upton Sheredine 10½ Jos Wood Received of M.r Ely Gassaway the Sum of eight Shillings and four Pence Sterling for the Alienation Fine due to Lord Proprietary by Virtue of a Commission from Dan.l of S.t Thomas Jenifer Esq.r his said Lordships Agent and Receiver General John Brice Recorded the 15.th Day of October 1773 |
