56 for their Servants Slaves Cattle and Carriages employed in and about digging for raising taking and carrying away the same over and through such Parts only of the said Tract for which the said Recovery should be suffered as aforesaid other than and not through the Dwelling Plantation aforesaid which said one hundred Acres of Land and the Ore aforesaid should be Limitted in the following manner to wit one undivided third part thereof to him the said James Russell his Heirs and Assigns one undivided sixth part thereof to the said Walter Ewer his Heirs and Assigns one undivided sixth part thereof to the said John Ewer his Heirs and Assigns and the other undivided third part thereof to the said John Buchanan his Heirs and Assigns the said Recovery to be with Single or double Voucher as advised and that and the said Deed or Deeds or Conveyances to be at the Costs and Charges of the said James Russell Walter Ewer John Ewer & John Buchanan the said Deed or Deeds or Conveyances containing no other than a Special Warranty with Covenant for further Effectual Assurances if required on which said Recovery being so as aforesaid suffered and the said Deed Deeds or Conveyances being executed and perfected the said James Russell Walter Ewer John Ewer & John Buchanan agreed to accept the same in full satisfaction of the said Agreement before mentioned to be made by the aforesaid John Howard and to Deliver up the same to the said Benjamin Howard party thereto as by the said recited writing relation being thereto had may fully appear And Whereas according to the said recited Agreement a Survey hath been made of the said one hundred Acres Beginning at a Locust Post standing on a Point on the East side of the Mouth of a Cove of Patapsco River and by the Side of the said River and running thence South Thirty two degrees East one hundred and fifty six Perches to the East Line of the said whole Tract called Yates's Inheritance then West one Hundred and Ten Perches to Patapsco River then running and binding on and with the said River the following Courses to wit North Eighty four degrees East Twenty two Perches North eighty one degrees East Twenty four Perches South forty four degrees East Sixteen Perches North seventy two degrees East eighteen Perches North thirty nine degrees East Sixteen Perches North fifty two degrees East Fifteen Perches to the first beginning Containing one hundred Acres and a survey according to the said recited agreement hath also been made of the Dwelling Plantation of the said Benjamin Howard the Grand father according to the Extent thereof in the Year seventeen hundred and thirty three Beginning at a bounded White Oak the beginning Tree of the said whole Tract called Yates's Inheritance and running the following Courses South Sixty seven degrees and an half degree East Thirteen Perches South forty degrees East Twenty Perches South twelve Degrees West one hundred and eight Perches South forty four degrees West Twenty one Perches South seventy nine degrees West eighteen Perches South seventy two degrees West Twenty perches North sixty four degrees West Twenty six Perches (North) |
