(55) Esquire the Person Signing the Certificate of Reverdy Ghiselin being Deputy Notary Publick of the Province aforesaid was at that Time and still is Secretary of the Province of Maryland aforesaid and that full Faith and Credit is and ought to be given to all Matters by him so signed In Testimony whereof I have hereunto set my hand and Caused the Great Seal of the said Province to be hereto Affixed this twenty eighth Day of L S September in the Year Seventeen hundred & seventy Recorded 29.th day of September 1770 Rob.t Eden 16 sides x.d This Indenture Tripartite made the Twenty ninth day of September in the Year of our Lord one Thousand seven hundred and seventy Between Benjamin Howard of Ann Arundel County Gentleman of the first part James Dick of Ann Arundel County Gentleman of the second part and James Russell Walter Ewer John Ewer and John Buchanan of Great Britain Partners in Iron Works of the other part Whereas on or about the Twentieth day of July last by a certain Instrument in Writing made Sealed and Delivered by and between them the said Benjamin Howard James Russell Walter Ewer John Ewer and John Buchanan it was agreed that he the said Benjamin Howard should at the ^then^ next Provincial Court suffer a common Recovery of and for such part of a Tract of Land called Yates's Inheritance for which his Father John Howard suffered a common Recovery in September Provincial Term seventeen hundred and fifty two and should by Deed Declaring the Uses of the said Recovery or such other Deed or Conveyance as required convey and make over to the said James Russell Walter Ewer John Ewer and John Buchanan the absolute Fee Simple of and in one Hundred Acres of Land part of the said Tract ^of Land^ called Yates's Inheritance with the Appurtenance the said one Hundred Acres to include the spot or place mentioned in the Agreement of John Howard the Father of him the said Benjamin Howard with Alexander Lawson Deceased & Company concerned in Iron Works to the said Writing annexed and to be Exactly & accurately surveyed as soon as might be and be butted bounded and Described in the said Deed according to such new Survey which should be so made as to Contain the Quantity of one hundred Acres And a survey should Likewise be made as soon as conveniently might be of the Dwelling Plantation of Benjamin Howard the Grand Father to Benjamin Howard party hereto according to the Extent thereof in the Year Seventeen hundred and thirty three and that the said Benjamin Howard should also by such Deed convey and make over to the said James Russell Walter Ewer John Ewer and John Buchanan in Fee all the Iron Ore Iron Mine and Iron Stone being in or on such part or parts of the said Tract called Yates's Inheritance for which the said Recovery should as aforesaid be suffered save and Except what thereof is within the Dwelling Plantation of Benjamin Howard the Grandfather to be ascertained as aforesaid and described in and by the said Deed with full and free Liberty and Priviledge to digg and turn up the Earth and Soil to Search for raise and take away the said Iron Ore Iron Mine and Iron Stone and to make what necessary Drains they may think fit and also full and free Ingress Egress and Regress (for) |
