552 On the 28.th Day of June seventeen hundred and seventy three Came the within Named Ann Ogle before me ^one of^ the Justices of the Provincial Court and Acknowledged the within Instrument of writing to be her Act and deed & the Premisses therein mentioned to be the Right & Estate of the said Benjamin Ogle agreeable to the time ^true^ Intent and meaning of the same Deed & the form of the Act of Assembly in such Case made and Provided 4¼ Dan of S.t Tho.s Jenifer Recorded 23.d July 1773 Maryland sc.t The Right Honourable Henry Harford Esq.r Absolute Lord and x.d Proprietary of the Province of Maryland To the Honourable William Fitzhugh of Calvert County Esquire Greeting Rob.t Eden Whereas for the due Administration of Justice it is most expedient that there be a Succession from the Dead to the living and that the Wills of all Persons devising or bequeathing any Real or personal Estate may be duly proved and Letters of Administration of the Estates of all Persons dying Intestate be granted to such who have Right therefore to the end there may be no failure of Justice therein but that it may be duly Administred within the Province to all persons concerned Know Ye that we very much relying and Confiding in the Knowledge Care Integrity and Ability of you the said William Fitzhugh have and by these presents Do ordain constitute and appoint you the said William Fitzhugh to be our Commissary General and Judge for Probate of Wills and granting Administrations within this our Province and in all the incidents and emergencies thereunto belonging or thereupon arising as well in taking the probate of all such Wills and granting Letters of Administration as also in receiving examining and passing all Inventories and Accounts whatsoever before you to be exhibited and at the Suit or Instance of any proper person or persons having or pretending to have any Interest in any Deceased's Estate within the Province to proceed adjudge Sentence and Decree the same and every of them and Administer Right and Justice to all persons therein concerned according to the known Laws and Customs of this ^our^ province and when those are Silent according to the Laws Usages and Customs of England and further We do grant unto You the said William Fitzhugh to exercise all Powers Rights Jurisdictions and privilidges lawfully belonging to a Court for taking the Probate of Wills and granting Administrations as aforesaid saving to all and every such person or persons that shall conceive themselves aggrieved by any definitive Sentence of you given or to be given their lawfull Rights of Appealing to us or our Govenor or Commander in Cheif of this Province for the Time being or to such other person or persons as We or they shall appoint to hear and determine the same To have hold execute and enjoy the said Office of Judge and Commissary General and Commissioner in Cheif for Probate of Wills and Granting |
