527 post containing six thousand three hundred and fifty nine square feet of Land which said portion or Lott of Ground lies in the City of Annapolis af.d and was heretofore bargained and sold by a certain Agnes Gordon to John Anderson the Father of the same John Anderson party to these presents with the appurtenances To have and to hold the said portion or Lott of Ground hereby granted sold and released or intended so to be with the appurtenances unto the same James Williams his Heirs and Assigns to the Use and Behoof of the same James Williams his Heirs and Assigns To the Intent and purpose that as well by Virtue of these presents as of the statute for transferring uses into possession the said James Williams may be and become a good and perfect Tenant of the Freehold and Inheritance of the Land and premisses af.d with the appurtenances against whom one or more Common Recovery or Recoveries may be had executed and perfected as herein after is mentioned and for that Intent and purpose it is agreed covenanted and concluded by and between all the parties to these presents that it shall and may be lawfull to and for the same James Tilghman to sue forth and prosecute his Lordships Writ of Entry sur Disseisin en le post returnable and to be returned before the Justices of ht Provincial Court to be held at the City of Annapolis af.d on the second Tuesday of April Anno Domini seventeen hundred & seventy three thereby demanding by apt and convenient names quantities and Descriptions the Lott or portion of Ground hereby bargained sold and released and all and singular the premisses with the appurtenances against the same James Williams to which said Writ the said James Williams shall appear gratis in his proper person or by his Attorney or Attornies lawfully authorised and shall and will enter into the said warranty and vouch over to warrant the same Lands and premisses with the appurtenances the Common vouchee of the same Court who shall thereupon appear and enter into the said warranty and after Imparlance make Default so that Judgment shall and may be had and given thereupon for the same James Tilghman to recover the same Land and premisses with the appurtenances against the same James Williams and for him to recover ^over^ in value against the same John Anderson and for the said John Anderson to recover in value against the Common Vouchee and such further proceedings shall be therein had that a good and perfect Common Recovery or Recoveries may be had prosecuted executed and perfected in and upon the said Writ of Entry in all things according to the usual course and Form of Common Recoveries for assurance of Lands in such Cases used And it is hereby covenanted concluded declared and fully agreed by and between all and every the said parties to these presents for themselves & their Heirs that from and immediately after the suffering & perfecting the said Common Recovery or Recoveries as aforesaid as well these presents and the assurance and assurances hereby made as also the said Recovery or Recoveries so as af.d or in any other manner or at any other Time or Times to be suffered of the af.d Land hereby granted sold and released and the premisses with the appurtenances or any part or parts thereof by or between the said parties to these presents shall be and enure and shall be construed |
