494 belonging or in any wise appurtaining To have and To hold the said four hundred and twenty five Acres of Land Together with all houses fencings orchards and Every Other the premisses and appurtinances unto the said William Russell his heirs and assigns for ever to the only proper use and Behoof of him the said William Russell his heirs and assigns for ever And the said Henry Barnes and his heirs the said moietys or parcels of Land unto the said William Russell and his heirs In manner and form affsd Conveyed against him the said Henry Barnes and his heirs and against all and Every Other person and persons whatsoever shall and will warrant and for ever Defend And the said Henry Barnes doth for himself his heirs Executors and adm.rs Covenant promise and agree to and with the said William Russell his Heirs and assigns that he the said William Russell and his Heirs shall and may peaceably and Quietly have hold Occupy possess and Enjoy the said Bargained premisses with their appurtinances free from the Lett Sute Mollistation or Interception of any person or persons whatsoever And further that he the said Henry Barnes and his heirs shall upon Request and at the Charges in the Law of him the said William Russell his Heirs & assigns make Do suffer Acknowledge and Execute any Other or further Act or Acts thing or things in the law whatsoever that shall by the said William Russell his heirs or assigns his or their Council learned in the Law be reasonably divised advised or required for the Better and more sure making the said bargained premisses to the said William Russell his heirs and assigns for ever In Witness whereof the party first above mentioned hath hereunto set his hand and affixed his seal the day and year above written Signed sealed and Delivered In presence of Henry Barnes (seal) And Buchanan William Corkey On the Back of the aforegoing Deed was thus Endorsed viz.t Baltimore County fs.t On the first day of January 1773 Came before us the subscribers two of his Lordships Justices of the Peace for Baltimore County Court Henry Barnes party to the within Deed and acknowledged the same as his Act and Deed and the Land and premisses therein mentioned to be the Right Title and Estate of William Russell his Heirs and Assigns for ever At the same time Came Ann the wife of the said Henry Barnes and acknowledged her Right of Dower to the said Land And being privately examined out of the hearing of her said Husband declared she did it freely and voluntarily of her own will and accord and not through any threats or Ill usage of her said Husband or fear of his displeasure Taken and acknowledged before us agreeable to the direction of the Act of Assembly in that Case made and provided And Buchanan Jn.o Smith Maryland baltimore County to wit I hereby Certify that Andrew Buchanan and John Smith Gentlemen before whom the above Acknowledgment was made and who have thereunto subscribed their names were at the day of the date thereof and |
