491) called Evans his land lying and being in Calvert County Also all that tract or parcell of plantable Land called Garresby lying and being in Calvert County And also all that tract or parcel of plantable Land called Stonesby lying and begin in Calvert County being the same Lands which were heretofore devised by James John Mackall to his wife Mary for life in the manner and according to the discritptions following to wit All my River side plantation being part of a tract of Land called Brooke Place Manor that I have a right to either in Law or Justice and all other my lands thereto adjoining or appurtaining All that part of a tract of Land called the Bush Maning that I have a right to either in Law or Justice All that part of a tract of land ^called^ Garey that I shall have a right to at the time of my Death And all that tract of Land called Cold Kirby together with all other my lands thereto adjoining or appurtaining And also all that tract or parcell of plantable Land called Battle Creek or the Exchange lying and being in Calvert County containing three hundred and fifty acres To which said writ the said Thomas Mackall did appear in his proper person and Vouch to warranty thereof the Common vouchee of the same Court and such further ^and other^ proceedings were thereupon had that the said John Rogers did by Judgment of the same Court recover his seisin against the said Thomas Mackall of and in the demanded premisses and the said Thomas Mackall did recover over in value against the Common Vouchee whereby a Common Recovery of the aforesaid premisses hath been and Suffered Now this Indenture Witnesseth that for the settling and declaring the intent and use of the said recovery and for and in consideration of five shillings Current Money by him the said Thomas Mackall to aforesaid John Rogers in hand paid the receipt whereof is hereby acknowledged It is hereby coven^an^ted granted agreed and declared by and between the said parties to these presents that the said Common recovery so as aforesaid or in any other manner had and Suffered and the Execution there^o^f from and immediately after the suffering the same or any other recovery or recoveries of the said mentioned Premisses or any part thereof was meant and intended to be and enure and is hereby declared to be and enure and that the recoveror therein named and his heirs should and shall stand and be seized of and in the recover'd Premisses and ev^er^y part or part or parcel thereof to and for the only proper use and behoof of the said Thomas Mackall his heirs and Assigns for ever and to and for no other use intent or purpose whatsoever In Witness whereof the parties to these presents have hereunto interchangeably set their hand and affixed their seals the Day and Year first above written Signed sealed and Delivered in the presence of us J Rogers (seal) |
