43 On the Back of the aforegoing Deed was thus Endorsed Viz.t 14.th Day of September 1770 Then came William Smith and Alice his wife before me the Subscriber one of his Lordships Justices of the Provincial Court and Acknowledged the within Instrument of Writing to be their Act and Deed and the Land & Premisses therein contained to be the Right and Estate of the within Named Samuel Smith his Heirs and Assigns according to the True Intent & meaning thereof Also Alice wife of him the said William Smith being by me privately Examined apart from and out of the Hearing of her said Husband did Repeat as above and also did Declare that she made this Acknowledgment willingly and freely and without being induced thereto by Fear or Threats of or ill Usage by her said Husband of fear of his Displeasure 7½ sides Philip Thomas Lee Recorded 14.th September 1770 x.d This Indenture made this fifteenth day of September in the Year of our Lord Seventeen hundred and Seventy Between the reverend John Hamilton of Charles Town in Cecil County and Province of Maryland and Patrick Hamilton of same Town County and Province of the one part and Rezin Rowles of Kent Island in the County of Queen Ann and Province aforesaid Merchant and Charles Rumsey of Cecil County in the Province of Maryland Farmer of the other part Whereas the said Rezin Rowles and Charles Rumsey at the request and Desire of the said John Hamilton and Patrick Hamilton have become jointly and Severally bound with the said Patrick Hamilton to the Commissioners Appointed by Act of Assembly for emitting Bills of Credit and other Purposes therein mentioned to wit Robert Couden and John Clapham in the Sum of Thirteen hundred and fifty Pounds Sterling Money of Great Britain with a Condition to the said Obligation annexed that upon the Payment of Six Hundred and Seventy five Pounds Sterling Money of Great Britain with the Interest therein mentioned at the days and Times therein mentioned then that the Obligation aforesaid should be void and of no Effect else to be and remain in full force and Virtue in Law And also Whereas Two Hundred and Twenty five Pounds Sterling Money as aforesaid was taken up of the Money aforesaid for the Sole and Seperate use of the said John Hamilton and paid to him and four Hundred and fifty Pounds residue of the said Six Hundred and seventy five Pounds taken up for the Sole and seperate Use of him the said Patrick Hamilton and paid to him the receipt of which said several Sums of Money they the said John Hamilton and Patrick Hamilton do hereby severally acknowledge and also that they the said Rezin Rowles and Charles Rumsey have had no part or parcel thereof Now This Indenture Witnesseth that the said John Hamilton for and in Consideration of the Premisses and for the further securing of the said Rezin Rowles and Charles Rumsey and indemnifying them of and from all Costs Charges Damages and Expences and Suits and each of their Heirs and Assigns that shall or may arise by Virtue of their being bound as aforesaid and also for and in Consideration of the Sum of Five Shillings to him the said John Hamilton by them the said Rezin Rowles and Charles Rumsey in hand paid the receipt whereof he the said John Hamilton doth hereby acknowledge and thereof and from every part and parcel thereof doth hereby Acquit and Discharge the said Rezin Rowles and Charles Rumsey their Heirs (Executors) |
