42 x.d This Indenture made the first day of September in the Year of our Lord seventeen Hundred and Seventy Between William Smith of baltimore County Planter and Alice his Wife Daughter of Thomas Smith Deceased of the one part and Samuel Smith of the said County Planter of the other part Witnesseth that the said William Smith and Alice his Wife for and in Consideration of the Sum of five Pounds Sterling Money to them in hand paid at or before the Ensealing and Delivery of these Presents the receit whereof is hereby acknowledged and for divers other good Causes and Considerations them thereunto moving more specially for the docking barring and Extinguishing all Estates Taill and all Reversions and Remainders thereupon Dependant of in to or out of the Lands hereafter described and for settling the same Have and each of them Hath granted bargained and sold released and confirmed and by these Presents Do and each of them Doth grant bargain and sell release and confirm unto him the said Samuel Smith his Heirs and Assigns All those tracts or Parcels of Land lying and being in Patapsco Neck in Baltimore County contiguous to each other called Sedgwell Containing Fifty Acres of Land more or Less and Harliston containing Fifty Acres of Land more or Less together with all and Singular the Houses Edifices Buildings and Improvements to the aforesaid several Tracts or Parcels of Land belonging and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and parcel thereof And all the Estate Right Title Interest use trust Property Claim and Demand whatsoever of them the said William Smith and Alice his Wife of in to or out of the said Premisses To have and to hold the said Several Tracts of Land and all and Singular the Premisses with the Appurtenances unto him the said Samuel Smith his Heirs and Assigns to the Intent and Purpose to make a good and Perfect Tenant of the Freehold of all and Singular the Lands Tenements and Premisses to the end that one or more good and perfect Recovery in the Nature of a common Recovery for the Assurance of Land may in due form of Law be had suffered Levied and perfected at the next or some Subsequent Provincial Court for the Lands aforesaid And it is hereby declared by all the Parties to these Presents and the True Intent and meaning hereof is that the said common recovery to be had of the Premisses or any part thereof shall be and enure and the said Samuel Smith and his Heirs and the Recoveror in such common Recovery his and their Heirs shall stand and be seized of all and Singular the Lands Tenements and Hereditaments in such Recovery respectively containing to and for the use and behoof of them the said William Smith and Alice his wife for and during the Term of their Natural Lives and from and after the Determination of the said Lives then to the use & Behoof of him the said Samuel Smith his Heirs and Assigns for ever and to or for no other use Intent or Purpose whatsoever In Witness whereof the Parties to these Presents have interchangeably set their hands and Seals the day and Year first above Written William Smith (seal) Signed Sealed & Delivered her in the Presence of Alice Smith (seal) The word "declared" between the 14 & 15 Lines Mark of the second side first interlined his John Moale Samuel S Smith (seal) Benjamin Ford Mark |
