(420) His Dwelling House of the said John containing twenty ^two^ Acres and one half acre more or less Bennetts Pasture co^n^taining Seven Acres more or less and Hogg Quarter containing two hundred and fifty Acres of Land more or less together with all and Singular the houses buildings and Improvements to the same Lands belonging and the Reversion and Remainder Rents Issues and Profits of said Lands and all the Estate Right Title and Interest of him the said John Bennett of unto or out of the same and every Parcell thereof and also the following negroe Slaves that is to say Jack, Tom, Moll, Sall and Kate and the increase of the said female Slaves To have and to hold the same Lands Tenements and Negroe Slaves and other the Premises with the Appurtenances with him the said Anthony Stewart his heirs and Assigns to the only proper use and Behoof of him the said Anthony Stuart his Heirs and Assigns for ever Provided always and the true Intent and meaning of these presents is that if the said John Bennett his heirs Executors Administrators or Assigns do and shall well and truely Pay to the said Anthony Stuart a Surviving Partner of Stuart and Richardson the aforesaid sum of six hundred and Sixteen Pounds sixteen Shillings and five Pence Sterling Money and also any Ballance that may hereafter appear due to the said Messrs James Dick and Stuart together with legal Interest for the same sums of Money at or before the First day of June which shall be in the year of our Lord Seventeen hundred and Seventy two then the above and foregoing Deed to be null and void othe^r^wise to remain in full force and Virtue in Law In Witness whereof the parties to these presents have hereunt set their hands and Seals the Day and year first within mentioned Signed Sealed and Delivered in Presence of us The words more or less being first interlined between the fourteenth & fifteenth line John Bennett (LS) James Dundass W.m Stewart Received the sum of five Shillings being the Consideration money within mentioned of the within named Anthony Stewart this 7.th Novem.r 1772 Witness James Dundass Will.m Stewart John Bennett 7th Nov.r 1772 Then came before us the Subscribers two of his Lordships Justices of the Peace for Ann Arundle County the within named John Bennett and Acknowledged the within Instrument of Writing to be his Act and Deed and the lands and Tenements and Negroe Slaves therein mentioned to be the right and Estate of the said Anthony Stuart his Heirs and Assigns according to the true Intent and meaning of the same Deed R Ghiselin 6½ sides W.m Stewart Recorded 15.th December 1772 |
