412 x.d This Indenture made the fifth Day of November in the Year of our Lord one thousand seven hundred and seventy two Between Thomas Watkins Elizabeth Hall and Thomas Henry Hall Executors of Henry Hall deceased and Henry Hall of Ann Arundel County eldest son and Heir at Law of the said deceased of the one part and John Hall of the City of Annapolis Attorney at Law of the other part Witnesseth that the said Thomas Watkins Thomas Henry Hall Elizabeth Hall and Henry Hall junior for and in Consideration of the Sum of nine hundred and five pounds sterling to them in hand paid being the highest Sum bid for the Land at last Frederick County August Court the Receipt of which said Sum is hereby acknowledged and the said John Hall his Executors and Administrators thereof and therefrom fully acquitted and discharged Have and each of them Hath granted bargained sold remised released and confirmed and by these Presents Do grant bargain sell remise release and confirm unto him the said John Hall his Heirs and Assigns all that Tract or Parcel of Land called Middle Plantation situate lying and being in Frederick County aforesaid containing by Patent five thousand four hundred and fifteen Acres of Land more or less Together with all and singular the Houses Buildings and Improvements thereto belonging and the Reversion and Remainder Rents Issues and Profits thereof and of every part and parcel thereof and all the Estate Right Title Interest Property Claim and Demand whatsoever of them the said Thomas Watkins Thomas Henry Hall Elizabeth Hall and Henry Hall junior of into or out of the Land and Premises herein conveyed or intended so to be To have and to hold the same Tract of Land and Premises with their Appurtenances unto him the said John Hall his Heirs and Assigns to his and their own proper Use and Behoof for ever And Whereas divers Parcels of the said Land have been heretofore contracted for and purchased by sundry persons under Agreements made with the said Henry Hall deceased in his Life time and part of the purchase Money hath been paid but the said parcels of Land have not been conveyed The said John Hall doth therefore covenant promise grant and agree for himself and his Heirs to and with the said Thomas Watkins Thomas henry Hall Elizabeth Hall and Henry Hall junior that he the said John Hall and his Heirs shall and will at the Request of the Vendors aforesaid and on the Money due on such Contract being paid to said Executors or such of them as have Right to receive the same convey and make over by good and sufficient Deeds of Bargain and Sale or otherwise all his the said John Halls Right and Title to the said several parcels of Land so contracted for as aforesaid to the Purchasors respectively their Heirs or Assigns as follows viz Thomas Beattys about thirteen hundred Acres William Wilson one hundred Acres Thomas Walters one hundred Acres Leonard Bourier two hundred Acres Philip Bourier one hundred Acres Philip Jacobs one hundred and fifty Acres And the said Thomas Watkins Thomas Henry Hall and Elizabeth Hall Executors ^as^ aforesaid in pursuance of the Terms of Sale for said Land do hereby covenant grant and agree to and with the said John Hall his Heirs Executors and Administrators that in case the Land purchased by the said John Hall as aforesaid should be intangled with and run into elder surveys that they will discount out of the purchase Money aforesaid in proportion to the Quantity of Acres so foul as aforesaid and the Sum given for the Land aforesaid bought at Publick Vendue and hereby meant to be Conveyed In Witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the Day and Year first above Written Signed Sealed and delivered Th.s Watkins (seal) in the presence of us Eliz Hall (seal) The words (Thomas Walters one hundred Th.s Hen.y Hall (seal) Acres) being first interlined Hn.y Hall (seal) Dan of S Tho.s Jenifer Thos Elliott The aforegoing Deed was thus Endorsed Viz.t Received on the Day and Year within written of and from the within named John Hall the Sum of Nine hundred and five pounds sterling being the Consideration Money within mentioned to be by him paid to us Dan of S Tho.s Jenifer Th.s Watkins Th.s Hen.y Hall 5.th Nov.r 1772 Then came Before me the Subscriber one of his Lordships Justices of the provincial Court the within named Thomas Watkins Thomas Henry Hall Elizabeth Hall and Henry Hall junior and severally acknowledged the within Instrument of Writing to be their respective Act and Deed and the Land and premises therein mentioned to be ^the^ Right and Estate of the within named John Hall his Heirs and Assigns for ever according to the true Intent and Meaning of the within Deed and the Act of Assembly in such case made and provided Acknowledged Before 8 sides Dan of S Tho.s Jenifer Recorded November the 5.th 1772 |
