(411) x.d This Indenture made the fifth day of November in the Year of our Lord one thousand seven hundred and seventy two Between Thomas Watkins Thomas Henry Hall and Elizabeth Hall Executors of Henry Hall deceased and John Hall of the City of Annapolis Attorney at Law of the one part and Henry Hall junior of Ann Arundel County eldest Son and Heir at Law of the said deceased of the other part Whereas the said Henry Hall deceased did by his last Will and Testament direct his Lands in Frederick County to be sold for the Payment of Debts and the Lands hereafter mentioned or some of them being under Mortgage to the said John Hall for Monies not heretofore Paid and the said Lands having been exposed to Publick Sale at the last Frederick County August Court Now this Indenture Witnesseth that the said Thomas Watkins Thomas Henry Hall Elizabeth Hall and John Hall for and in Consideration of the Sum of nine hundred and five Pounds Sterling to them in hand paid being the highest Sum bid for the Lands at at last Frederick County August Court the Receipt of which said Sum is hereby acknowledged and the said Henry Hall his Executors And Administrators thereof & therefrom fully acquitted and discharged Have and each of them Hath granted bargained sold remises released and confirmed And by these Presents Do grant bargain sell remise release and confirm unto him the said Henry Hall his Heirs and Assigns all those Tracts or Parcells of Land following lying and being in Frederick County aforesaid on or near the waters of Bennetts Creek viz The Range containing two thousand three hundred and two Acres and a Quarter of an Acre The Range containing two hundred and ten Acres Millers Grove containing ninety six Acres The Land of promise containing fifteen Acres Ebony Marsh containing thirty five Acres Lady containing one hundred Acres and part of the Tract of Land called Partnership not heretofore agreed to be conveyed to Solomon Turner John Jiams and Thomas Elliott and their Heirs or Assigns containing in said part now conveyed about three hundred Acres together with all and singular the Houses Buildings and Improvements to each and every of the said Tracts or Parcels of Land belonging and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every part and parcel thereof and all the Estate Right Title interest Property Claim and Demand whatsoever of them the said Thomas Watkins Thomas Henry Hall Elizabeth Hall and John Hall of into or out of the said Tracts or Parcels of Land and premises with the Appurtenances unto him the said Henry Hall his Heirs and Assigns for his and their own proper use and behoof for ever And the said Thomas Watkins Thomas henry Hall and Elizabeth Hall Executors as aforesaid in pursuance of the Forms of Sale for said Lands do hereby covenant grant and agree to and with the said Henry Hall his Heirs Executors and Administrators that in case the Lands purchased by the said Henry Hall as aforesaid should be intangled with and run into elder surveys that they will discount out of the purchase Money aforesaid in proportion to the Quantity of Acres so foul as aforesaid and the Sum given for the Lands as aforesaid bought at Publick Vendue and meant to be conveyed In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and Seals the Day and Year first above written Signed Sealed and Delivered Th.s Watkins (seal) In the Presence of us Eliz Hall (seal) Dan of S Tho.s Jenifer J Hall (seal) Tho.s Elliott Th.s Hen.y Hall (seal) The aforegoing Deed was thus Endorsed Viz.t Received ^on^ the Day and Year within written of & from the within Named Henry Hall the Sum of Nine hundred and five pounds Sterling being the Consideration within mentioned to be by him paid to us Witness Th.s Watkins Dan of S Tho.s Jenifer Th.s Hen.y Hall 5.th Nov.r 1772 Then came before me the subscriber one of his Lordships Justices of the Provincial Court the within named Thomas Watkins Thomas Henry Hall Elizabeth Hall and John Hall and severally acknowledged the within Instrument of Writing to be their respective Act & Deed & the Land & premises therein mentioned to be the Right Title & Estate of the within named Henry Hall his Heirs & Assigns for ever according to the true intent and meaning of the within Deed and the Act of Assembly in such case made & provided Acknowledged Before 8 Sides Dan of S Tho.s Jenifer Recorded November the 5.th 1772 |
