408 x.d This Indenture made the seventeenth day of October in the Year of our Lord seventeen Hundred and seventy two by and between Robert Darnall of Prince Georges County in the Province of Maryland Gentleman and Sarah Darnall his wife of the one Part and Sarah Muir the wife of James Muir of Dorchester County and daughter of the af.d Sarah Darnall of the other part Witnesseth that the said Robert Darnall and Sarah his wife for and in consideration of the natural Love and Affection which they have and do bear unto the said Sarah Muir and for Settling and Assuring the Lands and Premisses herein after mentioned after the Death of the said Sarah Darnall to and upon the said Sarah Muir and her Heirs as a Provision and Portion for the said Sarah And also for and in Consideration of the Sum of Five Shillings Sterling Money to them in hand paid by the said Sarah Muir at or before the sealing and delivery hereof the Receipt whereof they do hereby acknowledge and ther^e^of do acquit and discharge the said Sarah Muir his wife have given granted bargained and sold conveyed and confirmed and by these presents do give grant bargain & sell convey and confirm unto the said Sarah Muir and her Heirs and Assigns for ever from and after the death of the af.d Sarah Darnall all that Tract of Land called the Discovery lying and being in Dorchester County af.d Containing Three hundred and thirty two Acres of Land more or less And also all that other Tract of Land called Hope lying and being in Dorchester County af.d and adjacent ^to^ the af.d tract of Land called the Discovery containing fifty Acres of Land more or less with their and each of their Improvements and Appurtenances and the Reversion and Reversions Remainder and Remainders Rents and Services of the af.d Several Tracts of Land and premisses with their and every of their Improvements and Appurtenances To Have and to Hold the af.d Several Tracts of Land and Premisses with their Appurtenances from and after the death of the af.d Sarah Darnall unto the said Sarah Muir her Heirs and Assigns to her and their sole and Proper Uses for ever and to or for no other use Intent or Purpose whatsoever And the af.d Robert Darnall and Sarah his wife do for themselves their Heirs Executors and Administrators covenant grant and agree to and with the said Sarah Muir her Heirs and Assigns that they the said Robert and Sarah and their Heirs do and shall at any time hereafter when thereto required by the said Sarah Muir her Heirs or Assigns do make execute acknowledge and suffer all and every such further and other acts Deeds Assurances and conveyances in the Law for the further and better assuring confirming and conveying the af.d Lands and Premisses from and after the Death of the af.d Sarah Darnall unto the said Sarah Muir her Heirs and Assigns for ever as by the said Sarah Muir her Heirs or Assigns shall be reasonably advised devised or required Provided the same do not contain any clause therein that may deprive the said Robert and Sarah of their Right to the said Lands during the Lifetime of the said Sarah In Witness whereof the said Robert and Sarah have hereto sett their Hands and Seals the Day and Year af.d Robert Darnall (seal) Signed Sealed and Delivered In the Presence of Jane Fishwick Sarah Darnall (seal) P Hepburn Abraham Fisher The above Deed was thus Endorsed (Viz.t) Maryland fs.t Be it hereby Certified that on the seventeenth day of October in the Year seventeen hundred and seventy two personally appeared before me the subscriber one of his Lordships Justices of the Provincial Court the within named Robert Darnall and Sarah his wife Parties to this Deed and did acknowledge the same to be their Act and Deed and the Lands and premisses therein mentioned and contained unto the within named Sarah Muir her Heirs and Assigns for ever according to the true intent and meaning of the same Deed And I further Certify that I did examine the said Sarah Darnall the wife of the said Robert Privately and ^out^ of the hearing of her said Husband agreeable to the Act of Assembly in such cases made and provided and that she declared and Asserted that she made her Acknowledgment of the same Deed willingly and freely and without being induced thereto by fears and threats of or ill Usage by her said Husband or for fear of his Displeasure In Testimony whereof |
