407 that he the said John Henry and his Heirs and Assigns do and shall permit and suffer the aforesaid Amelia Green and her Assigns to have hold possess enjoy and have the free use of the said tract of Land and premisses with the Appurtenances for and during the natural life of her the said Amelia Green and no longer Provided always and upon Condition that the said Amelia Green do and shall within Ten Months next after the Death of the said Sarah Darnall Pay and satisfy unto Sarah Green daughter of the said Amelia Green of Dorchester County the sum of Twenty five Pounds Current Money at the rate of Dollars at Seven Shillings and six pence each and if the said Amelia shall refuse or neglect to pay the same within the time aforesaid then in trust and Confidence that the said John Henry his Heirs and Assigns do and shall permit and suffer the said Sarah Green to have hold use possess and enjoy the land and Premisses aforesaid to her own use for and during the space and term of four Years next after the expiration of the time so as aforesaid limited for the payment of the said Twenty five pounds and from and after the end of the said four years then in trust and to the use of the said Amelia Green for and during her natural Life and from and after the Death of the said Amelia Green then to the use and behoof of the aforesaid Thomas Green and the heirs of his Body lawfully begotton and for default of such Heirs of the said Thomas Green then to the use and behoof of the aforesaid John Green and the Heirs of his Body lawfully begotton and for default of such Heirs of the said John Green then to the use and behoof of the aforesaid Sarah Green and to the heirs of her Body lawfully begotton and for want of such Heirs of the said Sarah Green then to the use and behoof of all and every other son and sons of the said Amelia on her body to be begotten severally and successively one after another in order and course as they shall be in Seniority of Age and Priority of Birth and of the several Heirs of their several and respective bodies lawfully to begotton the elder of the said sons and the Heirs of his Body being always Preferred before the Young and the Heirs of their dodies and for default of such issues then to the use and behoof of all and every other Daughter and Daughters of the said Amelia Green on her Body lawfully to be begotton severally and successively one after another in order and course as they shall be in seniority of Age and Priority of birth and of the several Heirs of their several and respective bodies lawfully to be begotten the elder of the said daughters and the Heirs of her Body being always preferred before the Younger and the Heirs of their Bodies and for default of all and every such issues then to the use and behoof of the said Amelia Green and her Heirs and Assigns for ever to her and their sole and proper uses for ever and to or for no other uses intents or purposes whatsoever In Witness whereof the said Robert Darnall and Sarah his wife have hereto set their hands and seals the day and year first aforesaid Robert Darnall (seal) Signed sealed and delivered In the Presence of Sarah Darnall (seal) Jane Fishwick J Hepburn Abraham Fisher The above Deed was thus Endorsed (Viz.t) Maryland fs.t Be it hereby Certified that on the seventeenth day of October in the Year seventeen hundred and seventy two personally appeared before me the Subscriber one of his Lordships Justices of the Provincial Court the within named Robert Darnall and Sarah his wife Parties to this Deed and did severally acknowledge the same Deed and the Lands and Premises therein mentioned and contained unto the within named John Henry his Heirs and Assigns for ever to and for the several Uses Intents and Purposes therein limited and declared and according to the true intent and meaning of the same Deed And I further Certify that I did Examine the said Sarah Darnall privately out of the hearing of her said Husband agreeable to the Act of Assembly in such cases made and provided And that she declared and asserted that she made her Acknowledgment of the same Deed willingly and freely and without being induced thereto by fears or threats of or ill usage by her said Husband or for fear of his displeasure In Witness whereof I have hereto set my hand the Day and Year afd Before 14 sides J Hepburn Recorded October 19.th 1772 |
