360 Presents that the said Common Recovery so or in any other Manner to be had and suffered as aforesaid of the aforesaid premisses with the Appurtenances between the said Parties to these Presents shall enure and be and be construed deemed and taken to enure and to be to the Uses Intents and Purposes herein after mentioned and declared that is to say to the Use and Behoof of the said Daniel Charles Heath his Heirs and Assigns and it is hereby agreed between the said Parties to these Presents that from and immediately after the said Common Recovery or Recoveries shall be had and prosecuted as aforesaid of the said Lands and Premisses the said Recovery or Recoveries shall be and enure and are hereby declared to have been intended to be and enure that the said John Henry and every other Person that shall be seized of the Premisses or any Part thereof by Virtue of the said Common Recovery or Recoveries shall stand and be seized thereof and of every Part and Parcel thereof with their and every of their Appurtenances to the only Use and Behoof of the said Daniel Charles Heath his Heirs and Assigns and to no other Use Intent or Purpose whatsoever In Witness whereof the said Parties to these Presents have hereunto interchangeably set their Hands and Seals the Day and Year first above written Mary Heath (Seal) Sealed and delivered Dan.l Heath (Seal) In the presence of Tho.s Jenings (Seal) J A Thomas John Henry Jun (Seal) Received the Day of the Date of the said Indenture from the within named Thomas Jenings the Sum of five Shillings sterling being the Consideration Money within mentioned to be paid by him received by us Mary Heath Dan.l Heath On the Day of the Date of the within Indenture came the within named Daniel Charles Heath before me one one of his Lordships Justices of the Provincial Court and acknowledged the said Indenture to be his Act and Deed and the Lands and Premisses therein mentioned to be the Right of the within named Thomas Jenings his Heirs and Assigns for the Uses and Purposes therein mentioned also came before us Mary the Wife of the said Daniel Charles Heath Who being by me privately examined out of the Hearing of her said Husband acknowledged the said Indenture to be her Act & Deed and the Lands and Premisses therein mentioned to be the Right and Estate of the said Thomas Jenings his Heirs and Assigns for the Uses and Purposes therein mentioned & freely relinquished all her Right and Title thereto by Threats of ill Usage from her said Husband or Fear of his Displeasure 10¼ sides Taken & certified before W.m Hayward Recorded 10.th of Septem.r 1772 |
