359 whereof is hereby acknowledged and for divers other good Causes and Considerations them the said Daniel Charles Heath and Mary his Wife moving have bargained and sold and by these ^Presents do bargain & sell^ unto the said Thomas Jenings his Heirs and Assigns all these Tracts or Parcels of ^plantable^ Land following that is to say all that Tract or Parcel of plantable Land called Cole's Adventure containing one hundred and forty five Acres also all that Tract or Parcel of plantable Land called Finchley otherwise called Haydens Fair containing one hundred Acres also all that Tract or Parcel of plantable Land called Mitcham Hills containing one hundred and forty Acres and also all that Tract or Parcel of plantable Land called Addition to Guiberts Chance containing thirty eight Acres, which said last mentioned Tract or Parcel of Land is described as follows Beginning at a bounded red Oak a bound Tree of the said Land called Guiberts Chance and then with the said Land South twenty six Degrees Westerly eighty Perches to a bounded white Oak in a Valley a bound Tree of Saint Dorothey's then with the said Land South South West sixty six Perches to a bounded red Oak of Bushwood Lodge then with the said Land North by West one hundred and twelve Perches to a bounded Hickory then North East fifty seven Perches to another bounded Hickory of the said Land then with a straight Line to the first Tree containing thirty eight Acres all which said Tracts or Parcels ^of Land^ are situate lying and being in Saint Marys County To have and to hold the said Tracts or Parcels of Land and Premisses with their & every of their Appurtenances unto the said Thomas Jenings his Heirs and Assigns to the Intent and purpose nevertheless that the said Thomas Jenings may be perfect Tenant of the Freehold and Inheritance of all and Singular the aforesaid Premisses with the Appurtenances against whom a common Recovery ^of the same^ may be had suffered and perfected as of September Term next ensuing the Date of these Presents in which said common Recovery it is hereby agreed that the said John Henry shall be Demandant & the said Thomas Jenings Tenant and the said Daniel Charles Heath and Mary his Wife shall be Vouchees and they shall vouch over the Common Vouchee after the Manner and Course of a common Recovery for Assurance of Lands and it is hereby further covenanted, concluded, declared and fully agreed by and between all the said Parties to these (Presents) |
