346 346 June next as by the said in Part recited Bonds or Obligations with the Conditions thereunder written may appear Now Know ye that we the said Arbitrators whose Names are hereunto subscribed and Seals affixed taken upon us the Burden of the said Award and having fully examined and duly considered the Proofs and Allegations of both the said Parties in Manner following that is to say; First We do award and order that all Actions, Suits, Quarrels and Controversies whatsoever had, moved, arisen and depending between the said Parties in Law or Equity for any Manner of Cause whatsoever touching the said Premisses to the Day of the Date hereof shall cease and be no further prosecuted And we do also award and order that the Stone marked with three Notches planted by us the subscribers (at the Spot where it appears the End of the South East Line of the said Tract of Land Talbot's Resolution Manor now is) shall stand & remain a Boundary for the Beginning of the giving Line of Talbots Resolution Manor between the said Parties And further we do hereby award and order that the said Ephraim Howard for himself and his Heirs do acknowledge surrender and give up to Charles Hammond aforesaid and his Heirs all Title Claim & Possession to such Land as the said Ephraim Howard has now in Possession and which the given Line of Talbot's Resolution Manor aforesaid agreeable to the Award afs.d will leave out and is of Right the Estate and property of the said Charles Hammond We do also award and order that the said Charles Hammond do suffer and permit the afs.d Ephraim Howard to reap and Secure the Grain now growing on said Land and after such Grain is reap'd & secured then the said Ephraim Howard to deliver up Possession of said Land with its Appurtenances to the said Charles Hammond And lastly We do award and order that on or before the last Day of July next shall in due Form of Law execute each to the other of them or to the others Use general Release sufficient in the Law for releasing by each to the other of them his Heirs Executors and Administrators of all Actions, Suits, Arrests, Quarrels, Controversies and Demands whatsoever touching or concerning the Premisses afs.d on ^any^ such Matter or Thing thereunto relating from the Beginning of the World until the thirteenth Day of this Inst In Witness whereof we have hereunto set our Hands and (Seals) |
