316 Water Courses Profits Commodities Hereditaments and Appurtenances whatsoever to the said several Tracts and Parcels of Lands belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents and Issues thereof and of every Part and Parcel thereof To have and to hold the said several Tracts and Parcels of Land with the Appurtenances and all and singular the Premisses herein before mentioned unto the said Nicholas Maccubbin his Heirs and Assigns To his and their only proper Use and Behoof forever Provided always and these Presents are upon this Condition nevertheless that if the said John Roberts his Heirs Executors or Administrators do and shall well and truly pay or cause to be paid unto the said Nicholas Maccubbin his Executors Administrators or Assigns the afd Sum of one hundred Pounds Sterling Money of Great Britain with legal Interest ^thereon^ from the Date hereof at or upon the twenty ninth Day of April which shall be in the Year of our Lord seventeen hundred and seventy three without any Deduction Fraud or further Delay that then this present Indenture and every Clause herein contained shall cease and be utterly void to all Intents and Purposes as if the same had never been made and the said John Roberts for himself his Heirs Executors and Administrators doth covenant promise and agree to and with the said Nicholas Maccubbin his Executors Administrators and Assigns by these Presents that he the said John Roberts his Heirs Exors and Admors shall and will well and truly pay or Cause to be paid unto the said Nicholas Maccubbin his Exors Admors or Assigns the said Sum of one hundred Pounds Sterling Money of Great Britain together with the legal Interest thereon as afd and also the Cost and Charge of Recording this present Indenture at the Time herein before limited for Payment as afd and further that he the said John Roberts now at the Time of the Sealing and Delivery of these presents is lawfully and absolutely seised of a good sure perfect and indefeasible Estate of Inheritance in Fee Simple of and in the said Several Parcels of Lands and premisses with the Appurtenances herein before mentioned and hath in himself good Right and Title to grant and convey the same in Manner and Form afd and further ^that he^ the said John Roberts and his Heirs the before mentioned Parcels and Tracts of Lands and premisses with their Appurtenances unto the said Nicholas Maccubbin his Heirs and Assigns against the legal Title Claim and Demand and of all and every other Person or Persons whatsoever shall and will warrant and forever defend by these presents In Witness whereof the parties to these presents have hereunto set their Hands and Seals the Day and Year first above written Sealed and delivered in the presence of John Roberts (LS) Robert Saunders Joseph Dowson (On the Back of the aforegoing Mortgage was thus endorsed to Wit) Received of the within named Nicholas Maccubbin the Sum of one hundred £ Pounds Sterling Money of Great Britain, being the Consideration within mentioned 100 0 0 to be by him paid to me Witness John Roberts Robert Saunders (Maryland) Joseph Dowson |
