306 x.d This Indenture Tripartite made the twenty fourth Day of March in the Year of our Lord one thousand seven hundred and seventy two Between Catherine Griffith of Anne Arundel County Widow of the first Part John Worthington of Ann Arundel County Gentleman of the second Part and Thomas Johnson Junior of Ann Arundel County Gentleman of the third Part Witnesseth that the said Catharine Griffith for and in Consideration of the Sum of ten Pounds Current Money to her in Hand paid by the said John Worthington at or before the Sealing and Delivery these Presents the Receit whereof she doth hereby acknowledge and for the Docking barring and extinguishing all Estates Tail and Revertions and Remainders thereupon expectant or depending of and in that Part of the Tract of Land hereinafter mentioned with the Appurtenances hath given, granted, bargained, sold, aliened, released and confirmed and by these Presents Doth give, grant, bargain, sell, alien, release, and confirm unto the aforesaid John Worthington his Heirs and Assigns forever all that Part of the Tract or Parcel of Land lying and being in the County aforesaid called Howards Luck which is contained within the following Boundaries, Courses and Distances to Wit beginning at the No^r^thermost bounded Hickory of the said whole Tract and running South sixty six Degrees West sixty perches to another bounded Hickory bounding in the Room of an original bounded white Oak then South fifty three Degrees West five Perches to an old main Road then with that Road, South thirty five Degrees East twenty four Perches South twenty five Degrees and an half Degree East eighteen Perches South thirty seven Degrees and an half Degree East thirty four Perches South twenty seven Degrees East eighteen Perches South forty nine Degrees East twenty perches South eighty one Degrees East eighteen Perches South sixty two Degrees East ten perches South seventy six Degrees ^and^ an half Degree East thirty two perches South sixty five Degrees East twenty Perches South fifty nine Degrees and an half Degree East twenty two perches South seventy Degrees East thirty eight perches South fifty eight Degrees East forty four perches to intersect the Land called Chandlers Slaughter and from thence by a streight Line to the Beginning containing eighty six Acres of Land more or less together with all Houses, Buildings, Gardens, Orchards, Woods, Underwoods, Ways Waters Water Courses, Improvements, Advantages, Priviledges, and Appurtenances whatsoever on the same being or thereto in any manner appertaining and the Revertion and Revertions Remainder and Remainders, Rents, Issues and Profits thereof and of every Part and Parcel thereof and all the Estate, Right, Title, Interest, Use Trust Property Claim and Demand whatsoever of her the said Catharine Griffith of in or to the same or any Part or Parcel thereof To have and to hold the said part of the Tract of Land afd with it's Rights Members and Appurtenances to the aforesaid John Worthington his Heirs and Assigns forever ^to the Use of the said John Worthington his Heirs and Assigns for ever^ To the Intent and Purpose that the said John Worthington may be Virtue hereof be & become a good and perfect Tenant of the Freehold and Inheritance of and in the said Part of the Tract of Land aforesaid against whom one or more good and perfect common Recovery or Recoveries may be had perfected and executed to the Use, Intent and Purpose herein after mentioned and declared and to or for no other Use, Intent or Purpose whatsoever And thereupon it is covena^n^ted concluded and agreed by and between all the said Parties to these presents that before the End of April Provincial Term next one or more Writ or Writs of Entry sur Disseisin en le post shall be brought and prosecuted in the Name of the aforesaid Thomas Johnson Junior as Plaintiff or Demandant therein against the aforesaid John Worthington as Tenant or Defendant of & for the said Part of the Tract of Land aforesaid with the Appurtenances by such Name or Names Q^u^antity and Quality or such other Certainties or Discriptions as shall be apt and convenient in that Behalf to which Writ or Writs the said John Worthington shall appear Gratis in his proper Person and shall and will vouch to Warrant the premisses the said Catharine Griffith who shall likewise appear in her proper Person and shall vouch to Warrant the Common Vouchee and such further and other proceedings shall be had therein so that one or more good and perfect Common Recovery or Recoveries with double Voucher shall and may be had perfected and executed in all Things according to the usual Form of common Recoveries with double Voucher for Assurance of Lands in such Case used and accustomed and it is hereby covenanted agreed and declared by and between all the said Parties to these Presents that such Recovery or Recoveries so as aforesaid or in any other Manner to be suffered, executed, and (perfected) |
