       or any other proper Office within the said Province or any of them  To the
       Intent that this present Indenture & also the said last mentioned Indenture
       may be recorded & registred there in due Form & according to the Laws in such
       Cases made & provided  And the said Thomas Macnemara hereby giving &
       granting unto his said Attorneys & each of them his full & whole Power & Authority
       of in & concerning the said Premises & hereby ratifying & confirming
       whatsoever his said Attorneys or either of shall lawfully do or cause to be
       done in & about the Premises by Virtue of these Presents  And Lastly
       it is hereby mutually & reciprocally covenanted & agreed by & between the
       said Thomas Macnemara & Anthony Stewart for themselves severally &
       respectively & for their respective Heirs Exors & Admors that if upon the
       Admeasurement of the said Tract Piece or Parcel of Land by these Presents
       granted & released or intended so to be the same shall be found to contain more
       than thirty Acres of Land that then & in such Case the said Anthony Stewart
       his Heirs Exors & Admors shall & will well & truly pay or cause to be paid to
       the said Thomas Macnemara his Exors Admors or Assigns the Sum of one Pound
       & one Shilling of lawful Money of Great Britain for each & every of such Acres
       above the said thirty Acres  And that if upon such Admeasurement as aforesaid
       the same Tract Piece or Parcel of Land shall be found to contain
       less than thirty of such acres that then & in such Case the said Thomas
       Macnemara his Heirs Exors or Admors shall & will well & truly refund &
       pay or cause to be paid unto the said Anthony Stewart his Exors Admors or
       Assigns the Sum of one Pound & one Shilling of like lawful Money for
       each & every of such acres as the said Tract Piece or Parcel of Land shall
       appear to be less than the said Number of thirty acres any Thing in these
       Presents contained to the Contrary thereof in any wise notwithstanding
       In Witness whereof the said Parties to these Presents have hereunto
       set their Hands & Seals the Day & Year first above written

                   On the Back of the aforegoing going Release was thus endorst to wit

       Sealed & delivered by the within named Thomas Macnemara & Anthony
       Stewart (being first duly stampt) in the Presence of      Will McGachen
