270 his Heirs or Assigns the Rent of one Pepper Corn at the End of the said Term (if the same shall be lawfully demanded) To the Intent and Purpose that by Virtue of these Presents & of the Statute for transferring Uses into Possession the said Anthony Stewart may be in the actual Possession of the said Premises hereby bargained & sold & be thereby enabled to accept & take a Grant & Release of the Reversion & Inheritance of the same Premises to & to the Use of him his Heirs & Assigns In Witness whereof the said Parties to these Presents have hereunto set their Hands & Seals the Day & Year first above written Sealed & delivered Thomas M.cnemara (seal) (being first duly stampt) in the Presence of Will M.cGachin W.m Niven Tho.s Stewart On the Back of the aforegoing Lease was thus endorsed to wit Then came M.r William McGachen one of the Subscribing Evidences to the within Deed before us the Subscribers two of the County Justices for Baltimore County in the Province of Maryland & made Oath on the Holy Evangelists of Almighty God that he subscribed his Name as Witness to the within Deed & that he the said William Niven & Thomas Stewart the other subscribing Evidences sign their Names as Witness thereto at the same Time & that the said Deed was duly executed in their Presence by the Partys within mentioned November 25.th 1771 Benjamin Rogers 7½ Sides Recorded Nov.r 28.th 1771 And Buchanan X.d This Indenture Tripartite made the thirtieth Day of August in the eleventh Year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain France & Ireland King Defender of the Faith &c and in the Year of our Lord one thousand seven hundred & seventy one Between Thomas Macnemara late of the City of Annapolis in the Province of Maryland in America Surgeon but now a Surgeon belonging to the Ship called the Netronmena in the Service of the Empress of Russia (Eldest Son & Heir at Law of Michael Macnemara late of the City of Annapolis aforesaid Merchant of the second Part & Charles Wallace and James Dundas both of the City of Annapolis aforesaid Merchants of the third Part Whereas the said Anthony Stewart hath contracted & agreed with the said Thomas Macnemara for the absolute Purchase of the Fee Simple & Inheritance of & in the Tract Piece or Parcel of Land & Premises herein after particularly mentioned at or for the Price or Sum of thirty one Pounds ten Shillings of lawful Money of Great Britain Now This Indenture Witnesseth that for & in Consideration of the Sum of thirty one Pounds ten Shillings of lawful Money of Great Britain to the said Thomas Macnemara in hand well & truly paid by the said Anthony Stewart at or before the Sealing & Delivery hereof the Receipt & Payment whereof he the said Thomas Macnemara doth hereby confess & acknowledge & thereof & therefrom & of & from the same & every Part thereof doth acquit release & discharge the said Anthony Stewart his Heirs Exors Admors & Assigns & every of them for every by these Presents He (the) |
