26. and a Part from her Husband declared she made this Acknowledgement freely & of her own Will without any fear or threts of his Displeasure 6¾ sides Philip Thomas Lee recorded 16.th August 1770 x.d This Indenture made this Eight Day of August Anno Domini one thousand Seven hundred and Seventy Between William Deakins Junior of Frederick County in the province of Maryland Merchant of the one Part and Daniel Stephenson of Prince Georges County and Province aforesaid Merchant of the other Part Witnesseth that the said William Deakins Junior for and in Consideration of the sum of Forty eight Pounds Current Money to him in hand paid by the said David Stephenson before the ensealing and Delivery of these Presents the Receipt whereof the said Deakins Doth hereby acknowledge and thereof and of every part thereof Acquitt Discharge and Release the said Daniel Stephenson his heirs Executors and Administrators and every of them Hath Given granted Bargained sold and Confirmed and by these Presents Doth Give grant bargain sell and confirm unto him the aforesaid Daniel Stephenson his Heirs and Assigns forever all these two following tracts or Parcells of Land Viz.t First Mistake Situate lying and being in Frederick County and Province aforesaid Beginning at the end of the Seventeenth Line of a tract of Land called Deer Park lying near the west Point Branch of the Eastern Branch of Potowmack River and Runing thence South fifty five Degrees West one Hundred and fifty nine Perches West Sixty Perches South Seventeen Deg.s East Thirty Perches South sixty three Degrees East Fourteen Perches North Seventeen Deg.s West Twenty eight Perches East sixty Perches north Fifty five Degrees East One hundred and Fifteen Perches north Seventeen Deg.s East Fourteen Perches South Seventy eight Deg.s east Twelve perches north fifty five Degrees east twenty three Perches then with a Streight Line to the Beginning containing and laid out for eighteen Acres of Land more oe less Second Mistak Situate lying and being in Frederick County ^and Province^ aforesaid Beginning at the end of the twenty fifth line of a tract of Land called Bare Garden Enlarged lying on the east side of the west point Branch of the Eastern Branch of Potowmack River and runing thence South Seventeen Degrees west ninety Perches south Seventy two Degrees west sixty Perches South twenty one degrees and a quarter of a deg.s West twenty Perches ^North sixty Degrees west twelve perches^ north sixteen degrees east twenty two Perches north Seventy two Degrees East Sixty Perches north Seventeen Degrees East Eighty Eight Perches then with a Straight line to the Beginning containing Fourteen Acres of Land more or less with all the Premises thereunto belonging or appertaining to have and to hold the aforesaid two tracts of Land with all the Advantages Rights profits and Improvements thereunto belonging with all and Singular its Appurtenances unto him the said Daniel Stephenson his heirs and Assigns forever Free and clear of all incumbrances by from or under him the sid William Deakins Junior or any other Person whatsoever the rents and Services Growing due to the Lord Proprietor only excepted And he the said Deakins for himself and his heirs Covenants and agrees to and with the said Daniel Stephenson his heirs and Assigns that he the said Deakins and his Heirs and Assigns Shall and will at any time hereafter make do Execute and Acknowledge any other or Further act or Acts thing or things in the Law for the Better and more fully Securing the aforesaid two tracts of Land unto the said Daniel Stephenson his heirs or Assigns forever according to the true intent and meaning of the above Deed in Witness Whereof the said William Deakins Junior hath hereunto set his hand and Seal the Day and year first above Written Signed Sealed and Delivered William Deakins Jun.r (Seal) In the Presents of Andrew Heugh On the Back of the aforegoing Deed was thus Endorsed to wit Charles Jones Frederick County Ss.t 8.th August 1770 Received of Daniel Stephenson the sum of Forty eight Pounds Current Money it being the full Consideration for the within Land and Premises Witness Andrew Heugh William Deakins Jun.r Charles Jones |
