25 x.d This Indenture made this Sixteenth Day of August One thousand Seven hundred and seventy Between Richard Maccubbins and Elizabeth his Wife of the City of Annapolis of the one Part and Samuel Galloway of Ann Arundel County Gentleman of the other Part Whereas the said Elizabeth Maccubbins is Heiress at Law to Partrick Creagh formerly of the said City and as such is invested with all the right and Title which the said Patrick Creagh died possessed of in or to three several Lots and half a Lot of Ground lying and being in the said City adjacent and Bounding on the River Severn distinguished and Commonly known by the Names of the Brew House and Powder House Lots Now This Indenture Witnesseth that the said Richard Maccubbin and Elizabeth his Wife for and in Consideration of the Sum of five Shillings Sterling in hand paid by the said Samuel Galloway before the ensealing and Delivery of these Presents the receipt whereof the said Richard maccubbin and Elizabeth his Wife do and each of them doth hereby acknowledge have and each of them hath granted bargained sold released and Confirmed and by these Presents do and each of them doth grant bargain sell release and confirm unto the said Samuel Galloway his heirs and Assigns all and every of the aforesaid Several Lots and half a Lot of Ground lying and being in the City of Annapolis aforesaid adjacent and bounding on the River Severn and distinguished and Commonly known by the names of the Brew House and Powder House Lotts including the said Houses with all and every the Buildings Edifices, Fences, Improvements, Emoluments Advantages whatsoever thereon or any or either of them erected or Built situate lying or being or to or with them or any or either of them used occupied enjoyed or belonging with their and every of their Appurtenances and the Revertion or Revertions Remainder or Remainders Rents issues and Profits thereof and of every Part or Parcell thereof and also all Estate Right Title Interest, use, trust, Property, Equity of Redemption, Claim & Demand whatsoever both at Law and Equity of them the said Richard Maccubbin and Elizabeth his Wife of into or out of the aforesaid Three Several Lotts and half a Lott of Ground Premises and appurtenances and every part thereof Concerning or Relating to the Premises or Appurtenances or to any or to either of them to have and to hold the aforesaid Lotts and half a Lott of Ground and Premises with their and every of their Appurtenances unto him the aforesaid Samuel Galloway his heirs and Assigns to and for the only proper use and behoof of the said Samuel Galloway his heirs and Assigns forever and to and for no other use intent or purpose whatsoever In Witness whereof the Parties to these Presents have hereunto interchangeably set their hands and Seals the Day and Year above written Signed Sealed and Delivered Rich.d Mackubin (Seal) in the Presence of Elizabeth Mackubin (seal) Philip Thomas Lee Nathan Richardson On the Back of the above Deed was thus Endorsed to wit August y.e 16.th 1770 Then Received of the within named Samuel Galloway the within Sum of five Shillings Sterling being the Consideration Money mentioned in the within Deed to be by him paid to us Richard Mackubin Witness Philip Thomas Lee Nathan Richardson August y.e 16.th 1770 Then came before me the Subscriber one of his Lordships Justices of the Provincial Court the within mentioned Richard Maccubbin and Acknowledged the within instrument of writing to be his Act and Deed and the Lotts and half lott of Ground to be the right and Estate of the said Samuel Galloway and his heirs and then came also the within named Elizabeth Maccubbin and acknowledged the within instrument of writing to be her act and Deed and the Lotts and half Lott of Ground within mentioned to be the right and Estate of the within named Samuel Galloway and his heirs and being Examined Privately (and) |
