250 x.d This Indenture made this first Day of August in the Year of our Lord one thousand seven hundred and seventy one Between William Hall of Baltimore County in the Province of Maryland Gentleman of the one Part and Benjamin Rumsey of said County and Province Attorney and Practitioner at Law of the other Part Witnesseth that the said William Hall for the Docking barring and cutting off all Estates Tail and Remainders in Tail of & in all that Tract of plantable Land called Harmers Swanton containing two hundred acres situate lying & being in Baltimore County aforesaid & on the west Side of Chesapeak Bay near a Creek of the said Bay called Swan Creek respecting Elk Rivers Mouth on the Eastern Shore Beginning at the said Creeks Mouth & running South South East down the Bay for Breadth one hundred Perches to a marked Pock Hickory Tree bounding on the South by a Line drawn South South West from the said Pock Hickory for Length three hundred and twenty Perches to a marked Oak on the West with a Line drawn North North West from the said Oak one hundred Perches unto a marked Poplar Tree on the North with the said Creek and the East with the said Bay & for the settling & assuring the same to & for the Uses Intents & Purposes herein after limited expressed and declared Doth covenant conclude and agree to & with the said Benjamin Rumsey his Executors and Administrators for himself and his Heirs in Manner following that is to say that the said William Hall shall & will before the End of September Term next coming permitt and suffer the said Benjamin Rumsey to sue forth & prosecute against him the said William Hall one Writ of Entry sur Disseisin en le post returnable before the Right Honourable the Lord Proprietaries Justices of the Provincial Court thereby demanding against the said William Hall the said Lands Tenements Hereditaments and Premises herein before mentioned by such Name and Names Numbers of Acres Quantities, Qualities Terms and Descriptions in the said writ to be contained & in such Manner and Form as by Counsell learned in the law shall be advised unto and upon which said writ of Entry so to be prosecuted and sued forth the said William Hall shall appear gratis and vouch to warranty the common Vouchee who shall likewise appear and imparle and afterwards make Default and depart in Contempt of the Court so that Judgment may be thereupon had and given for the said Benjamin Rumsey to recover the said Lands Tenements Hereditaments & Premises against the said William Hall & for the said William Hall to recover in Value against the common Vouchee to the End one perfect Common Recovery with single Voucher may be thereupon had and suffered and all & very other Thing & Things be done & perfected needfull and convenient for the having & suffering the said Recovery according to the Course of common Recoveries in such Cases used and the same Recovery is also to be executed by one writ of habere facias Seisinam accordingly and it is hereby further covenanted concluded & agreed |
