24 Ex.d This Indenture made the twenty Second Day of June in the tenth Year of our Sovereing Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth and in the Year of our Lord one thousand Seven hundred and Seventy Between Samuel Chew of Maryland son of and heir to M.rs Henerietta Maria Dulany Deceased of the one part and Samuel Galloway Merchant of the other Part Witnesseth that the said Samuel Chew for and in Consideration of the sum of One hundred Pounds Current Money of Maryland to him in hand Paid by the said Samuel Galloway the Receipt whereof is hereby acknowledged and the said Samuel Galloway thereof and therefrom by these Presents fully acquitted and discharged Hath Bargained sold made over and Confirmed and by these Presents Doth bargain sell make over and Confirm unto the said Samuel Galloway his heirs and Assigns forever all that tract or parcel of Land called the Union Lying on the East side of Chesapeak Bay in Dorchester County Begining at a markt white Oak standing by the North side of the Long branch that Issueth out of the south side of Great Choptank River and Just by the first boundary of a tract of Land called the Exchange then runing East one hundred and Six Perches the South Forty three Degrees East ninty three perches then west north West forty Perches then south south west Seventy Perches then south fifty three degrees west thirty two perches thence west fourteen Perches thence North thirty degrees West one hundred and Sixty three Perches then south Eighty Degrees west twenty one perches then north Seventy Degrees West fifty four perches then south Eighty Degrees west One hundred and forty two perches then north one hundred and fifty Perches then North Eighty Degrees East two hundred and thirty two perches then by a Straight line to the first beginning white Oak containing three hundred acres more or less togeather with all buildings improvements profits Advantages ways waters Trees and appurtenances to the bargind Premises and every part thereof in any wise belonging or appertaining To have and to hold all and Singular the hereby bargained Premises and every part and parcel thereof to the said Samuel Galloway his heirs and Assigns forever to his and their own and to no other use intent or Purpose whatsoever and the Said Samuel Chew for himself and his heirs doth Covenant and agree to and with the said Samuel Galloway his heirs and Assigns that he the said Samuel Chew and his heirs the Bargained Premises and every part thereof to the said Samuel Galloway his heirs and Assigns from and against him the said Samuel Chew and from and against all persons whatsoever claiming from by or under him the said Samuel Chew and from and will warrant and defend by these Presents and Doth hereby Warrant and forever defend the bargained Premisses from himself and from all persons claiming by from or under him In Witness Whereof the said Samuel Chew hath to these Presents set his hand and seal the Day and Year above written Sam.l Chew (Seal) Sealed and delivered the word (Maria) in the third On the Back of the aforegoing Deed was thus Endorsed to wit line being first interlined J Hepburn Fra Chew Maryland fs.t Memorandum on the ^twenty^ Second Day of June Seventeen hundred and Seventy Sam.l Chew within mentioned acknowledged the within instrument of writing to be his Act and Deed and his right of the Lands therein mentioned to be sealed in Samuel Galloway & his heirs At the same time Elizabeth Chew wife of the said Samuel being privately examined out of the hearing of her said Husband declared that she freely voluntarily & of her own Accord relinquish't her Dower in the Land within mentioned and that she did it without being induced by fears or threats of her husband or apprehentions of his Displeasure taken before J Hepburn Reced of M.r Samuel Galloway the sum of ten Shillings and six pence Sterling for the use of Lord Baltimore by Virtue of a Commission from John Morton Jordan Esq.r his said Lordships agent and Receiver General J Brice 6½ Sides Recorded 17.th Day of July 1770 |
