247. X.d This Indenture Tripartite made this fourth Day of May in the Year of our Lord one thousand seven hundred and seventy one Between Benjamin Mackall the fourth of the City of Annapolis of the first Part, John Mackall Junior of Ann Arundel County of the second Part, and John Moore and Cassandra his wife of the third Part, Whereas a common Recovery hath been had and suffered in the Provincial Court in April Term in this present Year in the Name of him the said Benjamin Mackall as Plaintiff or Demandant against the said John Mackall as Tenant and John Moore and Cassandra his wife Vouchees of and for all that Piece or Part of a Tract of Land called Majors Choice which hath on the North side of a Creek in the County of Calvert called Fishing Creek Now This Indenture Witnesseth that the said John Moore and Cassandra his wife for and in Consideration of the Sum of seventy three Pounds ten Shillings Sterling Money to them in Hand paid by the said John Mackall Junior his Heirs and Assigns Have given granted bargained sold aliened enfeoffed and confirmed And by these Presents do give grant bargain sell alien enfeoff and confirm all the aforesaid Piece or Parcell of the said Tract of Land called Major's Choice which lieth on the North side of the aforesaid Creek called Fishing Creek in Calvert County aforesaid unto him the said John Mackall Junior his Heirs and Assigns for ever To have and to hold the aforesaid Piece or Parcell of Land and Premises with their and each of their Appurtenances to him the said John Mackall Junior his Heirs and Assigns And it is hereby further covenanted granted and declared by and between the said Parties that the said common Recovery so as aforesaid had and suffered and all other common Recoverie or Recoveries had made or suffered by or between the said Parties or wherein or whereto they were Parties of or for the aforesaid Piece or Parcel of Land with it's Appurtenances and the Execution thereof was meant and intended to be and enure and is and are hereby declared to be & enure to & for him the said John Mackall Junior his Heirs and Assigns to the only proper Use and Behoof of him the said John Mackall Junior his Heirs and Assigns for ever & to or for no other Use Intent or Purpose whatsoever And it is hereby further covenanted granted & declared by and between the said John Moore and Cassandra his wife and the said John Mackall Junior that they the said John Moore and Cassandra his wife their Heirs & Assigns the said Land & Premises with the Appurtenances from and against them the said John Moore and Cassandra his wife & their Heirs & from & against all manner of Person or Persons claiming by from or under them their Heirs or Assigns & from & against all Persons whatsoever shall & will warrant & for ever defend by these Presents In Witness whereof the said Parties to these Presents have hereunto set their Hands & affixed their Seals the Day & Year within written Benj.a Mackall 4th (Seal) Signed Sealed & delivered Jn.o Moore (Seal) (the word "each" in fourth Line of second Page first interlined) In the Presence of Cassandra Moore (Seal) Philip Thomas Lee |
