221 the said Samuel Willoughby and Henry Murray of in to or out of the said Land To have and to hold the said Tract or Parcel of Land called Skinners Choice and all and singular the Premises with the Rights Members and Appurtenances to him the said Daniel Sulivane Jun.r his Heirs and Assigns to the Intent and Purpose that the said Daniel Sulivane Jun.r may be and become perfect Tenant of the Freehold & Inheritance of the said Land and Premises that a common Recovery with double Vouchers over may be had and suffered against him in such Manner as is herein after mentioned and for that Purpose it is hereby covenanted granted and agreed by and between all the said Parties to these Presents that before the End of this Instant September Provincial Court one or more Writ or writs of Entry sur Disseisin en le post (at the Costs and Charges of him the said Samuel Willoughby) shall & may be brought and prosecuted against him the same Daniel Sulivane in the Name of him the said John Murray as Plaintiff or Demandant therein of and for the aforesaid Tract or Parcel of Land and Premises with the Appurtenances by such Name or Names Qantity Quality Number or Content of Acres or other certainties and Descriptions as shall be apt and convenient in that Behalf to which writ or writs the said daniel Sulivane Jun.r shall appear gratis in his proper Person or by his Attorney or Attorneys lawfully authorized and shall vouch to warrant the Premises the said Samuel Willoughby who shall likewise appe^a^r gratis in his proper Person or by his Attorney or Attornies lawfully authorized and shall & will enter into the said warranty and vouch over to warrant the same Premises the common Vouchee who shall thereupon appear and enter into the said warrant and after Imparlance make Default and such further and other Proceedings shall be therein so that one or more good & perfect common Recovery or Recoveries with double voucher shall and may be had suffered perfected and executed in all Things according to the usual Form of common Recoveries with double Voucher for Insurance of Lands in such Case used and accustomed And it is further covenanted, concluded, granted declared and fully agreed by and between all the said Parties to these Presents that from and after the suffering and perfecting the said Recovery or Recoveries as well these Presents and the Assurance hereby made, as also the common Recovery or Recoveries so as aforesaid or in any other Manner to be had suffered and perfected of said Land & Premises above mentioned shall be and enure and shall be adjudged construed deemed and taken and are and were meant and intended and are hereby declared to be and enure that the said John Murray and his Heirs and all and every other Person or Persons and their Heirs which shall be seised of the said Land and Premises or any Part thereof and of every Part and Parcel thereof with their and every of their Appurtenances to the only proper Use and Behoof of him the said Henry Murray his Heirs and Assigns for ever and to and for no other Use, Intent (or) |
