21 or belonging to the Estate of the said Bankrupts whether by Bond Note Bill Book Debt Account Consignment or otherwise howsoever nothing Excepted or Reserved and for the Purposes aforesaid to Account and to View State Settle and Adjust all Accounts and the Ballances thereof to receive Upon Receipts to give one or more Acquittances or other Sufficient discharges in due form of Law but in case of Refusal or Delay by any Person or Persons whom it doth or may Concern to make and Render just and true Account Payment Delivery and Satisfaction in the Premisses him them and every of them thereunto to Compel and for that Purpose in the Name of me the said Bartholomew Pomeroy in the Quality aforesaid to appear before all Lands Judges and Justices in any Court or Courts at Law or in Equity there to Answer defend and Reply in all Matters & Causes touching and concerning the Premisses to do say sue pursue seize Arrest Attach Implead Imprison and to Condemn out of Prison again to Deliver Also if need be to Compound Compromise Conclude and Agreed by Arbitration or otherwise And Generally in the Premisses to do perform Transact and Accomplish all and whatever shall be requisite and Necessary as fully and Effectually to all Intents and Purposes as I the said Bartholomew Pomeroy might or could do being personally Present with Power to my said Attorneys jointly or Severally to Substitute one or more Person or Persons to Act under them and the same at Pleasure to Revoke And I the said Bartholomew Pomeroy do hereby promise to Ratify and Confirm all and whatever my said Attorney or Attorneys or their or either of their Substitutes shall Lawfully do or Cause to be done in the Premisses by Virtue of these Presents In Witness whereof I have hereunto set my hand and seal the thirteenth day of March one Thousand seven hundred & seventy Sealed & Delivered in the Presence of Ab.m Dias Barth Pomeroy (seal) On the Back of the aforegoing Power of Attorney was as follows Viz.t London to wit Abraham Dias heretofore Clerk or Book Keeper to John Philpot & John Hutchinson late of London Merchants Bankrupts and afterwards Clerk or Bookkeeper to the said John Philpot during his Lifetime Maketh Oath as follows And first the Deponent saith that the Eighteen Accounts Current hereunto Annexed are just & true Copys from the Books of Account of the Estate of the said john Philpot and John Hutchinson and that he Verily beleives the same to be just and true in every Particular And further this Deponent saith that the Several Persons in the said Accounts Debited appear to be now justly and truly indebted unto the Estate of the said John Philpot and John Hutchinson in the Several Sterling Sums following being the Respective Balances of the said Accounts Current (that is to say) M.r Brian Philpot Jun.r in the Sum of Seven hundred and thirty seven Pounds two Shillings and nine pence Thomas Sligh in the Sum of Eight Hundred and Eighty nine Pounds four Shillings and nine pence three farthings Thomas Gough in the Sum of Fifty two Pounds Chales Ridgely and William Hammond in the Sum of Six Hundred and Seventy six Pounds and two pence Thomas Johnson in the Sum of Two Pounds nineteen Shillings and nine Pence Esther Rutter in the Sum of Nine Pounds one Shilling and two pence Jacob Hanson in the Sum of Two Pounds Nineteen Shillings and Eleven pence Darby Hernly in the Sum of Six Pounds Eleven Shillings and eleven pence Edward Norris in the Sum of Two Pounds & Eleven (Pounds) |
