151 two several Parcels of Parts of Tracts or Parcels of Land were devised to the said Neale Haile by his Father Nicholas Haile deceased and all and Singular the Messuages Tenements Priviledges Emoluments Advantages Hereditaments and Appurtenances whatsoever to the said several Parcels of Parts of Tracts or Parcels of Land or either of them belonging or any wise Appertaining or accepted reputed taken or known as Part Parcel or Member of them or either of them or belonging to the same or any part thereof (all which said Parcels of Land or Parts of Tracts or Parcels of Land Messuages Tenements Hereditaments and Premisses are now in the Actual Possession of the said Joseph Ensor by Virtue of a Bargain and Sale to him thereof made by the said Neale Haile for the Term of One whole year in Consideration of five Shillings Sterling Money to him paid by the said Joseph Ensor in and by one Indenture bearing Date the Day next before the Day of the Date of these Presents and by Force of the Statute for transferring Uses into Possession made and provided) and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits of the said Premisses and of every Part thereof To have and to hold the said Parcels of land or Parts of Tracts or Parcels of Land Messuages Tenements Hereditaments and all and singular other the Premisses with their and every of their Appurtenances unto the said Joseph Ensor his Heirs and Assigns to the Use of the said Joseph Ensor and of his Heirs and Assigns to the Intent that he the said Joseph Ensor may Perfect Tenant of the Freehold of the same Parcels of Land and each of them or Parts of Tracts or Parcels of Land Messuages Tenements Hereditaments and Premisses to the End and one or more good and Perfect Common Recovery or Recoveries may be thereof had and suffered in manner herein after mentioned for which Purpose it is hereby declared by and between the said Parties to these Presents that it shall and may be lawful to and for the said William Cooke before the End of April Term next ensuing the Date of these Presents to sur forth and Prosecute out of his Lordships High Court of Chancery one or more writ or writs of Entry sur disseisin en le post returnable and to be returned before his Lordships Justices of the Provincial Court at Annapolis thereby demanding by Apt and Convenient Names and other Discriptions the said Parcels of Land or Parts of Tracts or Parcels of Land Messuages Tenements Hereditaments and Premisses with their and each of their Appurtenances against the said Joseph Ensor to which said Writ or Writs of Entry he the said Joseph Ensor shall appear gratis in his own Proper Person or by his Attorney or Attorneys thereto lawfully Authorized and to Vouch to Warranty the said Neale Haile who shall also appear gratis in his own proper Person or by his Attorney or Attorney's thereto lawfully authorized and to enter into warranty and Vouch to Warranty the Common Vouchee of the same Court who shall also appear and after Imparlance make Default so as Judgment shall and may be thereupon had and given for the said William Cooke to recover the same Parcels of Land or Parts of Tracts or Parcels of Land Messuages Tenement Hereditaments and Premisses with the Appurtenances against the said Joseph Ensor and for him the said Joseph Ensor to Recover over in value against the said Neale Haile and for the said Neale Haile to recover in value against the Common Vouchee and that Execution (shall) |
