144 X.d This Indenture Tripartite made this twentieth Day of March in the year of our Lord God one thousand seven hundred and seventy one between Samuel Theobalds and Mary Theobalds (formerly Mary Smith) his Wife of Saint Marys County of the first Part Mathias Jones of the same County of the second Part and Thomas Stone of Charles County Attorney at Law of the third Part Witnesseth That the said Samuel Theobalds and Mary his Wife for the Docking and barring and Cutting of all Estates tail and remainders in tail of and in the Lands Tenements and Hereditaments herein after mentioned and for setling and assuring the same to and for the Uses Intents and Purposes herein after limited expressed and Declared And in Consideration of the sum of five shillings Current Money to them in Hand paid by the said Mathias Jones the Receipt whereof is by them hereby acknowledged Have and each of them Hath Granted bargained sod released and Confirmed and by these Presents Do and each of them Doth Grant bargain sell release and Confirm unto the said Mathias Jones (in his Actual Possession now being by Virtue of a Bargain and Sale to the said Mathias Jones by the said Samuel Theobalds and Mary his Wife of the said Lands Tenements and Hereditaments for one whole year from the Date of the said Bargain and Sale as by the same will appear) And to his Heirs and Assigns forever The following Tracts or Parcells or Part of Tracts of Land lying and being in Saint Mary's County afs.d that is to say all that Part of a Tract of Land called and known by the Name of Scotland being in the County aforesaid which lies on the North East side of a Line begining at a Locust Post being the second Boundary of the said Tract of Land called Scotland and running thence East South East to a marked Spanish Oak Tree thence South West to a Branch of Piney Neck Creek which said Line divides the said Tract of Land between the said Samuel Theobalds and Mary his Wife and a certain Solomon Jones and was devised to the said Mary by James Smith of the County aforesaid her Father containing two hundred Acres of Land Also all that Part of a Tract of Land called and known by the Name of the Narrows lying and being in the County aforesaid which lies to the West Side of a Line begining at the Head of a Sink near the Head of Point lookout Creek thence running North to a Marked Red Oak thence with the Main Road which leads from Point Lookout through the said County to Leonard Town thence with a Number of Marked Trees with a Path leading from William Thomas's Land to Solomon Jone's to the said Sink to begining as aforesaid being all that Part of the said Land called the Narrows which was devised by the same James Smith to the said Mary his Daughter as aforesaid containing two hundred Acres of Land Together with all Ways Waters Waters Houses Advantages Profits and Appurtenances to the same Tracts Parcells or Parts of Tracts of Land and each of them and every Part and Parcell of them and each of them belonging or appurtaining and the Reversion and Reversions Remainder and Remainders and all the Right Title Interest and Estate of them the said Samuel Theobalds and Mary his Wife and each in either of them to the said Premisses and Apurtenances and every Part and Parcell thereof To have and To hold the said Tracts Parcells or Parts of Tracts of (Land) |
