145 Land and Premisses with the Appurtenances and every Part and Parcell thereof unto the said Mathias Jones his Heirs and Assigns forever To the Intent and Purpose only that the said Mathias Jones shall become perfect Tenant of the Freehold of the said Lands and Premisses and shall and may ^stand &^ be seized thereof untill one two or more good and Perfect Common Recovery or Recoveries with double Voucher over may be duly had Suffered and Executed of the said Lands and Premisses with the Appurtenances and every Part and Parcell thereof according to the usual Course of common recoveries in such Cases for the assurance of Land as practised And thereupon it is Covenanted Concluded Granted and Agreed by and between all the Parties to these Presents for themselves and each of their Heirs Executors and Admrs and every of them by these Presents in manner following that is to say that the said Mathias Jones shall and will before the End of the next Provincial Court to be held at the City of Annapolis the second Tuesday in April in the year seventeen hundred and seventy one next ensuing permit and suffer the said Thomas Stone to Sue forth and Prosecute against him the said Mathias Jones one two or more writs of Entry Sur Disseisin en le post returnable before The Justices of the said Provincial Court at Annapolis thereby Demanding against the said Mathias Jones the said Lands and Premisses or each of them or either of them by such Names Number of Acres Quantities Qualities or Descriptions in the said Writ to be contained and in such Manner and form as by council learned in the Law shall be advised unto and upon which Writ of Entry so to be prosecuted and sued forth or Writs of Entry so to be prosecuted and sued out and unto every and each of them the said Mathias Jones shall appear gratis and Vouch to warranty the said Samuel Theobalds and Mary his Wife which said Samuel Theobalds and Mary his Wife shall thereupon appear and enter into into Warranty and after their entring into warranty shall Vouch to Warranty the Common Vouchee who shall likewise appear and imparl and afterwards make Default and Depart in Contempt of the Court so that Judgment or Judgments may be thereupon respectively had and given for the said Thomas Stone to recover the said Tracts Parcells or Parts of Tracts of Land and Premisses against the said Mathias Jones and for the said Mathias Jones to recover in Value from the said Samuel Theobalds and Mary his Wife and for the said Samuel and Mary to recover in Value against the Common Vouchee To the End one two or more perfect recoveries with Double Voucher may be thereupon had and suffered and all and every Thing and Things be done and Perfected needful and convenient for the having and suffering the said Recovery or Recoveries according to the Course of Common Recoveries in such Cases used And the same Recovery or Recoveries to be executed by one two or more Writs of Habere facias Seisinam accordingly And it is hereby further covenanted concluded and agreed by and between all the said Parties to these Presents for themselves and every of them their and every of their Heirs that the said Common Recovery or Recoveries so as aforesaid or in any other manner to be had and suffered (of) |
