143 West to a Branch of Piney Neck Creek which said Line divides the said Tract of Land between the said Samuel Theobalds and Mary his Wife and a certain Solomon Jones and was Devised to the said Mary by James Smith of the County aforesaid her Father containing Two hundred Acres of Land Also all that Part of a Tract of Land called and known by the Names of the Narrows lying and being in the County aforesaid which lies to the west side of a Line begining at the Head of a Sink near the Head of Point lookout Creek thence running North to a Marked red Oak thence with the main Road which Leads from Point Lookout through the said County to Leonard Town thence with a Number of Marked Trees with a Path leading from William Thomas's Land to Solomon Jones to the said Sink the begining as aforesaid being all that Part of the said Land called the Narrows which was Devised by the said James Smith to the said Mary his Daughter as aforesaid containing two hundred Acres of Land Together with all Houses ways Waters Advantages ^Profits^ and Appurtenances to the same Tracts or Parcells of Land and each of them and every Part and Parcell of them belonging or appertaining And the Reversion and reversions Remainder and Remainders Rents Issues and Profits of the Premisses aforesaid and every Part and Parcell thereof To have and To hold the said Lands and Premisses above mentioned and every Part and Parcell thereof with the Appurtenances unto the said Mathias Jones his Executors Administrators and Assigns from the Eighteenth Day of this Instant March for and during and untill the full End and Term of one whole year from thence next and Immediately ensuing and following and fully to be compleat and ended yielding and paying therefor one Pepper Corn at the End of the same Year if Demanded To the Intent that by Virtue of these Presents and by force of the Statute for transferring Uses into Possession he the said Mathias Jones may be in Actual Possession of all and singular the Premisses above mentioned with the Appurtenances and thereby be enabled to accept and take a Grant and release of the Reversion and Remainder and Inheritance thereof to him his Heirs and Assigns for the uses therein to be mentioned and Specified In Witness whereof the said Samuel Theobalds and Mary his Wife have hereunto sett their Hands and Seals the Day and Year first above Written Signed Sealed and Delivered Dan of S.t Tho.s Jenifer Sam.l Theobalds (seal) in Presence of Isaac Pavatt Mary Theobalds (seal) On the Back of the aforegoing Deed was Endorsed as follows, to wit On the 9th Day of April 1771 Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within Named Samuel Theobalds and Mary Theobalds his Wife and severally Acknowledged the with^in^ Indenture to be their Act and Deed according to the true Intent Purport and meaning of the same previous to which said Acknowledment of her the said Mary she was by me privately examined out of the Hearing of her said Husband upon which Examina^tion^ she confessed and Declared to Me that she made the said Acknowledgement willingly and freely and without being induced thereto by fear or threats of or Ill Usage by her said Husband or fear of his Displeasure Dan of S.t Tho.s Jenifer 6¾ sides Recorded this 10th Day of April 1771 |
