13 On the Back of the aforegoing Power of Attorney was thus Endorsed Viz.t Maryland Ann Arundel County to wit Came before me the Subscriber one of his Lordships Justices of the Peace for the County aforesaid James Wills one of the Subscribing Witnesses to the within Power of Attorney and made Oath on the Holy Evangelists of Almighty God that he was personally present and did see Rachel Moore Acknowledge & Execute as her proper Act and Deed the Power of Attorney within written and that the Name James Wills thereto set as a subscribing Witness is the proper hand writing of this Deponant Sworn to before me this 25.th Day of June Anno Dom seventeen hundred & seventy Recorded the 25.th June 1770 W.m Steuart 14 sides X.d This Indenture made this twenty ninth day of March in the Year of our Lord one Thousand seven hundred and seventy Between Thomas Mills of Frederick County and Province of Maryland of the one part and David Ross of Prince Georges County and Province aforesaid of the other part Witnesseth that the said Thomas Mills for and in Consideration of the sum of Eighteen Pounds Current Money of Maryland to him in hand paid by the said David Ross the receipt whereof the said Thomas Mills doth hereby acknowledge and of every part and parcel thereof doth hereby Acquit Exonerate and fully discharge the said David Ross have given granted bargained and sold and do by these Presents give grant bargain and sell unto the said David Ross his Heirs and Assigns for ever all that Tract or parcel of Land included by a warrant of Resurvey taken out of his Lordships Land Office by the said Thomas Mills on part of a Tract of Land called Antietum bottom convey'd by a certain John moor unto the said Thomas Mills lying at and near the Mouth of a Creek called Antietum where it emptys into Potomack River between a parcel of Land part of the aforesaid Tract of Land called Antietum bottom now in the Occupation of a certain Andrew house and Potomack River and also Laying to the South of a parcel of Land convey'd by the aforesaid Thomas Mills unto a certain John Bruner as may more fully appear in the Records of Frederick County in Liber H folio ^26^ by his Deed bearing date the fourteenth day of June one Thousand seven hundred and sixty two containing and now Laid out for Nine Acres of Land more or Less with all and every of the Appurtenances thereunto belonging To have and to hold his the said Thomas Mills right to the aforesaid Tract or parcel of Land and Premises together with all & singular the Improvements conveniences and Advantages to the same belonging or in any wise Appertaining to the only proper use and behoof of him the said David Ross his Heirs and Assigns for ever and to no other use intent or purpose whatsoever and the said Thomas Mills doth for himself his heirs Executors and Administrators covenant Promise and Agree with the said David Ross his Heirs & Assigns that the said Thomas Mills shall & will from time to time and at all Times hereafter at the reasonable request and at the Cost and Charge of him the said David Ross his Heirs and Assigns do make acknowledge suffer and Execute any further Deed or Instrument of Writing such as the said David Ross his Heirs or Assigns his or their Council Learn'd in the Law shall devise advise or require for the further better Assurance Security and sure making the Land and Premises aforesaid unto the said David Ross his Heirs and Assigns for ever Provided the same do not Extend or be Construed to Extend further than a Special Warrantee any thing herein Contained to the Contrary in any wise Notwithstanding In Witness whereof the partie first above mentioned have hereunto set his hand and Affix'd his Seal the Day and Year first above Written Sign'd Seal'd and Delivered in the Presence of us Tho.s Prather Thomas Mills (seal) Sam.l Beall Jun.r |
