127 X.d This Indenture Tripartite made this 18.th day of Septemb Anno Domini Seventeen hundred and seventy Between Daniel Dulany Junior of the City of Annapolis Esq.r of the one part Nathaniel Waters of the County of Ann Arundel of the second part and Elie Vallette of the aforesaid City of the third part Witnesseth whereas by an Indenture bearing date the 16.th day of March in the year seventeen hundred and Fifty nine made between Walter Dulany Esquire Natural Guardian of Daniel Dulany the son of him the said Walter Dulany of the one part and Cornelius Garretson of the City of Annapolis of the other part he the said Walter Dulany as Natural Guardian of the said son Daniel for the Consideration therein Mentioned did Demise Grant and ^to^ Farm let unto the said Cornelius Garretson all that Lot or Parcel of Ground lying and being in the Old Town of the City of Annapolis (Except as therein Excepted) distinguished in the Plot of the Survey thereof made by James Stoddart on or about the 25.th day of July 1718 by the Number Fifty To have and to hold the said Lot and parcel of Ground unto the said Cornelius Garretson his Executors Admors and Assigns from the day next before the Date of the said Indenture for and during and until the full end and Term of Ninety nine Years from thence next ensuing fully to be Compleat and ended And the said Walter Dulany did in and by the said recited Indenture amongst other Things Covenant that he the said Daniel Dulany his Heirs and Assigns should and would at the end and Expiration of the said Time of Ninety nine years upon the request and at the Cost and charge of the aforesaid Cornelius Garretson his Executors Admors and Assigns make seal deliver and in due form of Law Execute and fully perfect one other Lease and Demise of the hereby Demised premisses to the aforesaid Cornelius Garretson his Executors Admors and Assigns for the Term of Ninety nine Years then next following and at the end and Expiration of the said last mentioned Term shall also Lease and Demise the said Demised premises for other Ninety nine Years and so from Time to Time should make such Renewment forever And Whereas by another Indenture bearing Date the 18th day of March in the Year of our Lord Seventeen hundred and fifty nine made between the aforesaid Cornelius Garretson of the one part and the aforesaid Nathaniel Waters of the other part He the said Cornelius Garretson did for and in Consideration of the Rents Covenants and agreement mentioned Demise Grant and to Farm let unto the said Nathaniel Waters all that part or parcel of Ground being part of the Lot aforesaid lying and being in the old Town of the City of Annapolis and distinguished in the plot of the resurvey thereof made by James Stoddart, as aforesaid, by the Number Fifty Beginning at a Locust post standing in the Westermost Side of South East Street and running thence North West with the said Street Twenty seven feet and half a foot to the Church circle and running by and with the said circle to the Eastermost side of South Street then running with the said Eastermost side of South Street South Thirty feet and thence running South thirty three degrees East Sixty three feet and half a foot and thence with a streight line to the Beginning Locust Post containing six thousand eight hundred seventy two and a half square feet To Have and To Hold the said part or parcel of Ground with the appurtenances to the said demised premises belonging unto the said Nathaniel Waters his Executors Admors and Assigns from the Day next before the day of the Date of the said Indenture for and dureing and until the full end and Term of Ninety nine years from thence next ensuing and fully to be compleat and ended renewable forever under the Rents and Covenants therein expressed Now this Indenture (Witnesseth) |
