118 McCullock by his last will and testament bearing date on or about the twenty ninth day of August Seventeen hundred and sixty six duely proved and recorded did direct and desire that all his houses and lotts in Joppa and other real Estate in Maryland should be ^sold by^ his Executors and of the said will constituted and appointed to the said Mary McCullock & Anthony Stewart Executors who having taken upon themselves the Execution of the said will did heretofore after convenient notice given in the Maryland Gazette Sett up & Expose to sale all those lotts of Land lying in the Town of Joppa in Baltimore County known and distinguished by number four & eighteen & a small parcel of Land thereunto contiguous At which said public sale a certain James Dick did purchase a part of the above mentioned lott number eighteenth sundry improvements thereon and a certain James Christie did purchase a part of the above mentioned lott number four with sundry improvements thereon as by Deeds of conveyance to them the said James Dick & James Christie upon record reference being thereto had may more fully & at large appear and whereas at a public sale thereafter made the above named James Russell by his Attorney Charles Grahame did purchase the remaining parts of the above mentioned lotts Number four, number Eighteen & a small parcel of Land thereto contiguous for the sum of Two hundred & seventy five pounds sterling Now this Indenture witnesseth that the said Mary McCullock & Anthony Stewart for and in consideration of the sum of two hundred and seventy five pounds Sterling to them in Hand paid at or before the ensealing & delivery of these presents the receipt whereof is hereby acknowledged, Have & each of them hath granted bargained sold aliened Enfeoffed & confirmed and by these presents do and each of them doth grant bargain sell alien release enfeoffe and confirm unto the said James Russell his Heires and Assigns forever all that the aforesaid remaining part of Lotts number four and eighteen & a small parcel of Land thereto contiguous lying in the Town of Joppa and County aforesaid and all the appurtenances & advantages thereto belonging and also all the estate right title interest use trust property claim & demand whatsoever of the said Mary McCullock & Anthony Stewart and either of them in and to the same premisses & appurtenances and every part and parcell thereof To have and to hold the above said Lotts of Land and premisses with all and every the appurtenances hereby bargained and sold unto the said James Russell his heirs and Assigns for ever To the only proper use & behoof of him the said James Russell his heirs and Assigns for ever to and for not other use intent or purpose whatsoever and that he the said James Russell his heirs & assigns shall and may at all times for ever hereafter peaceably & quietly have hold occupy possess and enjoy all and singular the above premisses hereby bargained & sold and intended to be sold without the least trouble hinderance molestation interruption & denial of them the said Mary McCullock & Anthony Stewart or either of them or of any person or persons claiming or to claim by from or hunder them or either of them or by or from the said David McCullock In Witness whereof the above parties first to these presents have hereunto set their hands & seals the day and year first above written Signed, Sealed and Delivered in presence of Mary McCullock (seal) The words "of the other part" being first interlined in the third line Anthony Stewart Philip Thomas Lee Nath Nicholson |
