112 More effectual Assurance and Conveyance of the said Tract or Parcel of Land and Premises with the Appurtenances to him the said Charles Carroll his Heirs and Assigns Provided always that if the sad Henry Brown his Heirs Executors or Administrators do and shall well and truly pay to the said Charles Carroll his Executors Administrators or Assigns the said Sum of Three hundred and Seventy Seven Pounds Sterling with legal Interest thereon together with the Charge of recording this Indenture on or before the eighth day of January which shall be in the Year of our Lord Seventeen hundred and Seventy Seven then this Indenture and every Clause Matter and Thing therein contained shall cease determine and be void And the said Henry Brown for himself his Heirs Executors and Administrators doth hereby covenant and grant to and with the said Charles Carroll his Executors Adm.rs and Assigns that he the ^said^ Henry Brown the said Three hundred and Seventy seven pounds Sterling with legal Interest thereon together with the Charge of recording this Indenture to him the said Charles Carroll his Executors Adm.rs or Assigns on or before the said eighth Day of January which shall be in the Year of our Lord Seventeen hundred and Seventy seven will well and truly pay In Witness whereof the Parties to these Presents have hereunto interchangeably set their Hands and affixed their Seals the Day and Year first above written Signed Sealed and Delivered in the Presence of Hen Brown (seal) Mary Carroll Will Deards On the Back of the aforegoing Deed was thus Endorsed to wit Received on the Day and Year first within written of and from the within named Charles Carroll the sum of Three hundred and seventy seven pounds Sterling being the Consideration Money within Mentioned to be by him paid to me I say received by me Witness Hen Brown Mary Carroll Will Deards On the Eighth Day of January Seventeen hundred and seventy one Came before me the Subscriber one of his Lordships Provincial Justices the within named Henry Brown and acknowledged the within Deed to be his Act and Deed and the Land and Appurtenances within mentioned to be the Right and Estate of the within named Charles Carroll his Heirs and Assigns for ever according to the true Intent and meaning of the within Deed and the Act of Assembly in such Case made and provided Recorded the 8.th day of January 1771 Philip Thomas Lee 8¼ sides |
