10 X.d Maryland fs.t This Indenture made this Eighteenth day of May in the Year of our Lord God one Thousand seven hundred and Seventy Between James Smith of Trinity mannor in S.t Marys County Gent of the one part and William Loker of the said County Planter of the other part Witnesseth that whereas a Common Recovery was had and suffered at a Provincial Court held at the City of Annapolis the Second Tuesday of April Anno Domini seventeen hundred and seventy between William Hayward Esq.r Chief Justice and his Assoat.s Justices of the same Court of Two Hundred and fifty Acres of Plantable Land with the Appurtenances in the said County of S.t Marys being part of the said Trinity Mannor lying in S.t Michaels Hundred Bordering on Potomack River called Calverts Rest by the following Metes and Bounds Viz.t Begining at a Locust Post Standing in the Root of Pines which is one of the Bound Trees of a Tract of Land called Henry James.s Neck from thence running to the head of a Branch of Broad Creek called Henry James.s Branch where Trinity Mannor Line ends so from the head of the said Branch with the said Mannor to the side of a Creek called Calverts Creek and with the said Creek to Potomack River and with the said River to the Mouth of a Creek called Board and so bounding with the Northern Branch of the said Creek to the head thereof and from the head of the said Branch of a Little Gully or runn to the aforesaid Locust Post being the beginning and containing Laid out for Two hundred and fifty Acres of Land be the same more or Less with Appurtenances together with all Buildings Improvements Profits Commodities and Advantages whatsoever to the same belonging wherein Bartholomew Smith of S.t Marys County aforesaid was Demandant and the said James Smith was Tenant who vouched Warranty a certain William Rawlings the Common Vouchee and Whereupon a Writt Seisen hath been Issued and Executed as by the Record and Process of the said Recovery remaining in the Provincial Court may Appear which same Recovery was had to the end and Purpose that the said James Smith might be Enabled to convey unto the said William Loker his Heirs & Assigns forever an Estate of Inheritance in fee Simple of in and to the said Two hundred and fifty Acres of Land and Premises with the Appurtenances to the use of him the said William Loker his Heirs and Assigns for ever and to no other use Intent or purpose whatsoever Now This Indenture Witnesseth that the said James Smith for and in Consideration of the Sum of Six Hundred and fifty Pounds Currency to him in hand paid by the said William Loker the recept whereof is hereby acknowleged Hath ^given^ granted Bargained and sold made over and Confirmed and by these Presents Doth give grant Bargain and sell make over and Confirm unto the said William Loker the aforesaid two hundred and fifty Acres of Land together with all Buildings Improvements Profits commodities and Advantages thereunto belonging with their and every of their Appurtenances To Have and to Hold to him the said William Loker his Heirs and Assigns forever to his and their own use & Behoofe and to no other use intent or purpose whatsoever And it is Covenanted & Agreed by and between all the said Parties and there Heirs that the said Recovery had and suffered and is hereby declared to be to the use and Behoofe of the said William Loker his Heirs and Assigns and to the Intent and Purpose that he and they may be invested with a Indefeazable Estate of Inheritance in Fee Simple of in and to the said Land and Premisses with the Appurtenances and the said James Smith for himself and his Heirs Doth Covenant Grant Agree to and with the said William Loker his Heirs and Assigns that (he) |
