(91) proper Use and Behoof And the said Thomas Davis for himself his heirs and assigns doth covenant & agree to and with the said William Williams his heirs and assigns that he the said Thomas Davis and his heirs the said Tract or parcel of Land and premisses with the appurtenances hereby bargained and Sold with the Appurtenances and every part and parcell thereof to him the said William Williams his heirs and assigns against him the said Thomas Davis his Heirs and Assigns and against all other person or persons claiming from by or under him or Them shall and will warrant & defend In Witness whereof the parties to these presents have hereunto interchangeably set their Hands and affixed their Seals the Day and Year first above Written Sealed and Delivered in the presence of Geo Steuart Tho.s Daviss (seal) (the words called the Exchange "& new Exchange enlarged" between the 19.th & 20.th Lines being first interlined) Dan.l Dulany (seal) On the Back of the Aforegoing Deed was thus written viz.t May the 29.th 1766 Received of William May the 29.th 1766 Received of William Williams the sum of £134 19 7 sterling the Williams the sum of £43 0 5 Sterling the consideration money within mentioned consideration money within mentioned to to be paid to me be by paid to me P Dan.l Dulany P Tho.s Daviss May the 29.th 1766 Came the within named Thomas Davis and Daniel Dulany Esq.r before me the Subscriber one of the Right Honourable the Lord Proprietary His Justices of the Provincial Court and Severally Acknowledged the within Deed to be their Act and Deed and the Land & premisses within mentioned to be the Right and Estate of the within named William Williams his heirs and assigns according to the true intent and meaning of the within Deed and the act of assembly in such cases made and provided Geo Steuart Received the 30.th May 1766 of William Williams the Sum of Eight Shillings sterling for the use of Lord Baltimore it being the Alienation Fine on the within Land and by virtue of a commission from Edward Lloyd Esq.r his said Lordships Agent and Receiver General Recorded 30.th May 1766 John Davidson Sides Ex.d This Indenture Made the Twenty Ninth day of May in the year of our Lord Christ one thousand Seven hundred and Sixty six Between John Brice of the City of Annapolis in the Province of Maryland Esquire and Sarah his Wife of the one part and John Brice Junior of the City aforesaid Gentleman of the other part (witnesseth) |
