(90) the third Part Witness That Whereas the said Thomas Davis did on or about twentieth Day of December in the year Seventeen hundred and Sixty three for a valuable Consideration Mortgage unto the said Daniel Dulany All that Tract or parcel of Land with the Appurtenances in Frederick County afs.d called or known by the Name of the Young Man's Delight being part of a Tract of Land called the Exchange and new Exchange enlarged on the head Draughts of Captain John as by the said Mortgage duly enrolled amongst the Records of the Provincial Court Reference being thereto had may more fully appear And Whereas the said William Williams hath agreed with the said Thomas Davis for the Purchase of the said Tract or parcel of Land with the appurtenances thereto belonging And Whereas the Sum of one hundred & thirty four Pounds nineteen Shillings & seven pence Sterl.g hath been paid to the said Daniel Dulany one of the Parties to these presents Now This Indenture Witnesseth that the said Daniel Dulany for and in consideration of the sum of one hundred and thirty four pounds nineteen Shillings & Seven pence Sterling to him in hand paid the receipt whereof he doth hereby acknowledge I thereof doth acquit & discharge the said William Williams his Executors and Administrators Hath as he doth by these Presents release All his Right Title Claim or Demand of in or unto the said Tract or parcel of Land with the Appurtenances in Frederick County aforesaid called or known by the name of the Young Man's Delight being part of a Tract of Land called the Exchange and new Exchange enlarged on the Head Draughts of Captain John beginning in the sixth Line of a Tract of Land called the Exchange and new Exchange enlarged and so running the Several and respective Lines and courses mentioned & described in a Deed of Indenture made or mentioned to be made between Daniel Carroll Merchant of Prince Georges County Merchant of the one part and the said Thomas Davis of the other part as (by reference being had to the said Deed among the Land Records of the said Provincial Court may more fully Appear To have and To hold the said Tract or parcel of Land hereby described as aforesaid unto the said William Williams his heirs and assigns for ever And this Indenture further witnesseth that the said Thomas Davis for and in Consideration of the further Sum of forty three Pounds and five Pence Sterling to him in hand paid by the said William Williams the Receipt whereof he the said Thomas Davis doth hereby acknowledge and thereof doth acquit & discharge the said William Williams his Executors and administrators Hath given granted bargained and Sold and by these presents doth give grant bargain and Sell unto the said William Williams his heirs and assigns The Tract or parcel of Land herein before mentioned and intended to be hereby bargained and Sold together with all the improvements thereupon being and also all the Right Title Interest Claim and Demand in and to all and singular and every the Premisses in the said Deed from Daniel Carroll to the said Thomas Davis contained To have and To hold the same and every part thereof to the said William William his heirs & assigns for ever to and for his and their (proper) |
