73 Baltimore County fs.t Know all men by these presents that I James Heath of the County afs.d Gentleman am held and firmly bound unto Isaac Gibbs of Cecil County Merchant in the full and just sum of six hundred & seventy five pounds current Money of Maryland to be paid to the said Isaac Gibbs his certain attorney Executors administrators or assigns to which payment well and faithfully to be made and done I bind my self my heirs Executors and Administrators firmly by these presents Sealed with my seal and dated this 29.th day of October Anno Domini 1765 The Condition of the above obligation is such that Whereas the above bounden James Heath by his certain Deed of Bargain & sale bearing even Date with these presents hath conveyed unto the said Isaac Gibbs in Fee Simple apart or parcell of Land being part of two Tracts of Land lying and being in Cecil County af.d containing & Laid out for Two hundred and fifty seven and one half Acres of Land for and in consideration of six hundred & seventy five pounds current Money of Maryland as may more fully and at Large appear recourse to the same Deed being had Now the Condition of the above Obligation is such that in case any part or parcell of the said Tract or parcell of Land by the Same Deed conveyed or intendey to be conveyd Should be taken away or be included by any elder survey or by any act done by the said James Heath so that the said Isaac Gibbs his Heirs or Assig^n^s should not retain or keep the said number of acres intended to be thereby conveyed to him & them that if the said James Heath his Heirs Executors and administrators shall pay unto the said Isaac Gibbs his Heirs & Assigns at at the rate of two pounds ten shillings current money as af.d for every acre that shall be cut of or taken from the said Quantity thereby Conveyed or intended to be conveyed by the said Deed then the above Obligation to be void else to remain in full force & virtue in Laws Signed Sealed & Delivered in Presence of James Mathews Lee Dekeyser James Heath (Seal) On the Back of the Aforegoing Bond was thus written viz.t The words Current money of Maryland as mention in the within Should have been Current money Pensylvania Currency I paid for the Land, and should any Part of said Land be Taken away I expect that within Bound James Heath will refund me two pounds ten Shillings Pensylvania currency for ever acor so taken away Testis sides Lee Dekeyser, James Mathews Isaac Gibbs Recorded 11.th Feby 1766 |
