720 Bennett Begining at the south bounded Tree of the Land surveyed for Thomas Marsh being a Mulberry Tree and running south down the Bay for the Length of four Hundred and seventy five perches to a marked Mulberry Tree and bounding on the south by a Line drawn west from the said Mulberry Tree four hundred Perches on the west by a Line drawn North from the end of the former Line unto the Land of the said Thomas Marsh on the North with the said Land on the West with the said Bay Containing Eleven hundred and fifty Acres of Land more or Less together with all Houses Buildings Gardens Orchards Woods Under Woods Waters Water Courses Profits Commodities Hereditaments & Appurtenances whatsoever to the same belonging or in any wise Appertaining And the Revertion and Revertions Remainder and Remainders Rents Issues and Profits of all and Singular the same Premises and every part & parcel thereof with their and every of their Appurtenances And also all the Estate Right Title Interest Claim and Demand of them the said John Moore and Cassandra his wife and each of them of into or out of the said Premises with the Appurtenances or any part or Parcel thereof in any wise howsoever To Have and to Hold the said Tract or parcel of Land and all and Singular other the Premises herein before mentioned with their Appurtenances unto the said Samuel Chew his Heirs and Assigns to the use and behoof of him the said Samuel Chew his Heirs and Assigns forever Nevertheless to the Intent that he the said Samuel Chew by Virtue of these Presents may be and become a good and perfect Tenant of the immediate Freehold and Inheritance of all and singular the said Premises with their Appurtenances against whom a Common Recovery may be had perfected and Executed in such Manner as is herein after mentioned And for that Purpose it is Covenanted concluded and Agreed by and between all the said Parties to these Presents that before the end of April Provincial Term seventeen Hundred and seventy at the proper Costs and Charges of the said Samuel Chew one Writ of Entry sur Disseisin en le post shall and may be brought commenced and prosecuted returnable to the said Provincial Court in the Name of the said Baker Johnson whereby the said Baker Johnson shall Demand against the said Samuel Chew the said Tract or parcel of Land and all and Singular ^other^ the said Premises with their Appurtenances by Quality and Content of Acres as shall be proper in that Behalf to which writ the said Samuel Chew shall appear gratis in his own proper Person or by his Attorney or Attornies lawfully Authorised and shall and will Vouch or call to warrant the same Premises the said John Moore and Cassandra his wife who shall also appear gratis in their own proper persons or by their Attorney or Attornies lawfully Authorized and shall and will enter into the said Warranty and Vouch over to Warrant the same Premises the common Vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make Default and such further and other Proceedings shall be had upon the said writ and all the said Parties shall so demean themselves therein that one good and perfect Common Recovery with Double Voucher shall and may be had suffered ^perfected^ and Executed of for or upon all & Singular the said Premises (with) |
