(677) same or any part or parcel thereof belonging or in any wise Appertaining To Have and to Hold the said Five hundred Acres of Land together with all Houses fencings Orchards and every other the Premises and Appertinances unto the said Benjamin Burgess Cheney his Heirs and Assigns for Ever to the only proper use and behoof of him the said Benjamin Burgess Cheney his Heirs and Assigns for ever And the said Samuel Chew and his Heirs the said Tract or Parcel of Land unto the said Benjamin Burgess Cheney and his Heirs in manner and form aforesaid convey'd against him the said Samuel Chew and his Heirs and against all and every other person and Persons whatever shall and will warrant and for ever defend And the said Samuel Chew doth for himself his Heirs Executors and Administrators Covenant Promise grant and Agree to and with the said Benjamin Burgess Cheney his Heirs and Assigns that he the said Benjamin Burgess Cheney and his Heirs shall and may peaceably and Quietly have hold Occupy Possess and Enjoy the said Bargained Premises with their Appertinances Free from the Lett suit Mollestation or Interuption of any person or persons whatsoever And further that he the said Samuel Chew and his Heirs shall upon Request and at the Charges in the Law of him the said Benjamin Burgess Cheney his Heirs and Assigns make do suffer Acknowledge and Execute any other or further Act or Acts thing or things in the Law whatsoever that shall by the said Benjamin Burgess Cheney his Heirs or Assigns his or their Counsell Learned in the Law be reasonably devised Advised or required for the better and more sure making the said Bargained Premises to the said Benjamin Burgess Cheney his Heirs and Assigns for ever In Witness whereof the party first above mentioned hath hereunto set his hand and Affixed his Seal the day and Year above Written Signed Sealed and Delivered W.m Paca Sam.ll Chews (Seal) In the Presence of Daniel Pennington On the Back of the aforegoing Deed was thus Endorsed Viz.t Reced 4 April 1770 of M.r Benjamin Burgess Cheney the just Sum of one Thousand Pounds Current Money it being the Consideration Money for the within mentioned Land and Premises Test Mary Hesselius W.m Paca Sam.ll Chew S Then Came before the subscriber one of his Lordships Justices Samuel Chew and Acknowledged the within Instrument of Writing to be his Act and Deed and the Land thereby Conveyed to be the Right and Estate of the said Benjamin Burgess Cheney and his Heirs April 4.th 1770 Geo Steuart Received the Sum of Twenty Shillings Sterling (for the use of Lord Baltimore) being the Alienation Fine on the within Land by Virtue of a Commission 7½ sides from John Morton Jordan Esq.r his said Lordships Agent & Receiver General Jn.o Brice Recorded 5.th April 1770 |
