676 Ex.d Know all men by these Presents that I Benjamin Burges Cheney of Baltimore County and province of Maryland Planter am held and firmly bound unto John Elder of said County and Province aforesaid in the full and just Sum of Seven hundred Pounds Sterling Money of Great Britain to be paid unto him the said John Elder or his certain Attorney Executors Administrators or Assigns to which Payment well and truly to be made and done I bind myself my Heirs Executors and Administrators or Assigns firmly by these Presents Sealed with my Seal and Dated this 2.d Day of April one Thousand seven hundred and Seventy the Condition of the above Obligation is such that if the above bound Benjamin Burgess Cheney by himself his wife and there Heirs Executors Administrators shall make over all there Right or Rights of Percells of Lands this day Conveyed the said John Elder if required by said John Elder his Heirs or Assigns for further Surety or Surety's of said Land so that the said John Elder his Heirs or Assigns may have and Indesputable Title to the said Lands for ever then the above Obligation to be void else to remain in full force and Virtue in Law Signed Sealed and Delivered in the Presence of us Tho.s Gassaway son Nich.s Benj.a Burges Cheney (Seal) Edw.d Dorsey son Ed 2 sides Recorded 2.d day April 1770 X.d This Indenture made this fourth day of April Anno Domini seventeen hundred and seventy Between Samuel Chew of Ann Arundel County in the Province of Maryland Gentleman of the one part and Benjamin Burgess Cheney of Baltimore County in the Province affsd Planter of the other part Witnesseth that the said Samuel Chew for and in Consideration of the Sum of one Thousand Pounds Current Money to him in hand paid before the Ensealing and delivery of these Presents by the said Benjamin Burges Cheney the receipt whereof he the said Samuel Chew doth hereby acknowledge and himself therewith fully Satisfied Contented and paid and hath given granted bargained sold Allien'd Enfeoffed and Confirmed And by these Presents doth fully clearly and Absolutely give grant bargain sell Allien Enfeoff and Confirm unto the said Benjamin Burgess Cheney his Heirs and Assigns for ever all that Tract or parcel of Land called Dunkiel lying and being in Baltimore County Butted and Bounded as follows Begining at a bounded Poplar standing on the East Side of a run called Winters run and running thence North Three hundred and twenty perches then West Two hundred and fifty perches then South Three hundred and twenty perches then with a Streight Line to the first Begining Containing and Laid out for Five hundred Acres of Land more or Less together with all Houses Fencings Orchards and all and every other Improvements and Appertinances to the (same) |
