639. as by the said Edward Tilghman his Heirs or Assigns or any of them or by his their or any of their Counsel Learned in the Law shall be reasonably Devised or Advised and required so as the said further Assurances to be made or any of them do not nor shall not contain any further Assurance or Warrant then for enjoying them only against the same Henry McLachlan and his Heirs and further the same Henry McLachlan for himself and his Heirs doth hereby Covenant and grant to and with the same Edward Tilghman his Heirs & Assigns that the aforesaid Tracts or Parcells of Land and Premisses hereby granted or mentioned to be hereby grant and conveyed as afsd and every part & parcel thereof with all and singular their and every of their Appurtenances now are & be and for ever henceforth hereafter shall Continue remain and be unto the same Edward Tilghman his Heirs & Assigns free & clear and freely and clearly and Absolutely freed and Acquitted exonerated and Discharged of and from all and all manner of former & other Bargains Sales Gifts Grants Feoffments Estates Leases Rights Rents Arrearages of Rents Issues Debts Duties Judgments Executions and all Debts of Record Charges Troubles Forfeitures Annuities and Incumbrances whatsoever had, made Committed done acknowledged or Suffered or caused to be had made committed done Acknowledged or Suffered by the same Henry McLachlan In Witness whereof the Parties to these Presents have interchangeably put their Hands & Affixed their Seals the Day and Year first above written Sealed & Delivered Henry McLachlan (Seal) in the Presence of E.d Tilghman (seal) Rob.t Lloyd Hugh Neill Ja.s Hollyday (seal) On the Back of the aforegoing Deed was thus Endorsed Viz.t Received on the day and Year first within Written of and from the within Edward Tilghman the Sum of Two thousand two hundred and five pounds Pensylvania Currency being the Consideration Money within mentioned to be by him paid me Rob.t Loyd Henry McLachlan Hugh Neill On the Twenty fifth day of November in the Year of our Lord one Thousand seven hundred and sixty nine came before me the Subscriber one of the Justices of the Provincial Court the within Henry McLachlan Edward Tilghman and James Hollyday and Severally and respectively acknowledged the within Instrument of Writing to be their Act and Deed to and for the Uses Intent and Purpose therein particularly Specified and the Lands and Premisses therein contained to be the right & Estate of the same Edward Tilghman his Heirs & Assigns for ever Dan of S.t Tho.s Jenifer Recorded 16.th December 1769 X.d Know all Men by these Presents that John Steuart of London Merchant on his own private Account and preceeding Partnerships and John Steuart and Duncan Campbell of London Merchants and Partners on their joint Account Have and each of them Hath made Ordained Constituted & Appointed and by these Presents Do and each of them Doth make ordain Constitute and (Appoint) |
