(565) declared granted and fully agreed upon by and between all the said parties to these presents that from and after the Suffering and perfecting the said recovery or recoveries so as aforesaid or in any other manner to be had Suffered and perfected shall be and enure and shall be adjudged deemed and taken and are and were meant and intended and are hereby declared to be and enure to the recoveror or Recoverors in the said recovery or recoveries named or to be named and he and they and his and their heirs shall stand and be Seized of the Several tracts and parcells of Land aforesaid and every part and parcell thereof and Premisses with the Appurtenances to and for the only proper use and behoofe of him the said John Frederick Augustus Priggs his Heirs and Assigns forever and to or for no Other Use intent or Purpose whatsoever In Witness whereof the parties to these presents have hereunto interchangeably Set their Hands and affixed their Seals the day and year first above written Signed Sealed and delivered John F A.s Priggs (Seal) in the presence of us Sarah Prigg (seal) W.m Reynolds D Chamier Henry Brookes (seal) J Rogers On the back of the aforegoing Deed was thus Endorsed viz.t Received on the Day and year first within written of and from the within named Henry Brookes the Sum of five Shillings Sterling Money being the Consideration Money within Mentioned to be by him paid to us John F A.s Priggs Witness W.m Reynolds D Chamier Sarah Priggs On the 24.th day of May Seventeen hundred and Sixty nine Came the within named John Frederick Augustus Priggs and Sarah his wife Henry Brookes and John Rogers before me the Subscriber one of his Lordships Justices of the Provincial Court and severally acknowledged the within Instrument of writing to be their respective Act and Deed and the Lands and premisses therein mentioned with the Appurtenances to be the right and Estate of the within named Henry Brookes his Heirs and Assigns forever according to the intent and Purpose of the same writing at the same time the said Sarah the wife of the said John Frederick Augustus Priggs being by me examined privately apart from and out of the hearing of her said Husband declared she made such Acknowledgment and joined in the execution of the within Deed and the Common Recovery of the Lands and premisses therein mentioned willingly and freely and without being induced thereto by fears or threats of or ill usage by her said husband or fear of his displeasure according to the Act of Assembly in such Case made and provided recorded the 24.th Day of May 1769 Before Dan of S.t Tho.s Jenifer Ex.d This Indenture made this twenty third Day of May in the year of our Lord One thousand seven hundred and Sixty nine Between Basil Williams of Frederick County Planter of the one part and Henry Ridgely of Ann Arundel County Gentleman of the Other Part Witnesseth that the said Basil Williams for and in Consideration of the Sum of one hundred and Sixty three pounds Current Money by him the said Henry Ridgely to him the said Basil Williams in Hand paid at and before the Sealing and Delivery of these presents the receipt whereof he doth hereby Acknowledge and him the said Henry Ridgely of every Part thereof doth Acquit exonerate and discharge hath granted bargained & sold & by these Presents doth grant bargain and Sell unto the said Henry Ridgely his Executors Administrators & Assigns one hundred and fifty Acres of Land lying on the West End of a Tract of Land called Basils Choice in Frederick County with the Appurtenances To have and to hold the said one hundred and fifty Acres of Land with the Appurtenances thereunto belonging unto the said Henry Ridgely his Executors Administrators & Assigns Provided always that if the said Basil Williams shall pay or cause to be paid unto the said Henry Ridgely his Executors Administrators or Assigns the full Sum of one hundred & Sixty three pounds Current Money with legal Interest for the same from the Date of these presents on the first Day of October next that then this present writing Shall be utterly void and frustrate and the said Basil Williams for himself his Executors Administrators & (Assigns) hun |
