(564) and running thence with the first Line of Thomas Smith Greenfields eighty five Acres Viz.t South Sixty three Degrees thirty Minutes Westerly two hundred and eight perches to the third line being the South twenty nine degrees East line of a parcell of Land formerly mortgaged by James Greenfield deceased to his Brother Thomas Trueman Greenfield of Saint Marys County which said parcell of Land is now in the possession of the said Thomas Smith Greenfield thence running with the said line and bounding there with South twenty nine Degrees East until it intersects the main North branch of Deep Creek thence down the said branch as the said branch runneth and bounding therewith until it intersects with the fourth line being the west thirty six perch line of the parcell of Land mentioned in the Deed of Trust aforesaid thence running with the said line West to the end thereof thence with the fifth line of the said Land North West thirty two perches thence with the head line of the said Land and bounding therewith North eight Degrees East to the beginning aforementioned containing one hundred and thirty five Acres of Land more or less together with all Edifices Buildings Gardens Orchards Ways Waters Water Courses Commodities priviledges Improvements Emoluments Advantages and Appurtenances whatsoever to the same Several tracts and parcells of Land belonging or Appurtaining and the reversion and reversions remainder and remainders Rents Issues and profitts thereof and of every part and parcell thereof and also all the Estate right Title Interest use Trust profitt Property Claim and demand whatsoever of them the said John Frederick Augustus Priggs and Sarah his wife of in and to the said Several tracts and parcels of Land and of in to and out of every part and parcell of them and each and every of them To have and to hold the said Several tracts and parcells of Land and every part and parcell of them and each and every of them and premisses with the Appurtenances to him the said Henry Brookes his heirs and Assigns to the intent and Purpose that the said Henry Brookes may be and become perfect tenant of the freehold and Inheritance of the said premisses that a Common recovery may be had and Suffered against him in such manner as herein after mentioned and for that purpose it is hereby Covenanted granted declared and Agreed by and between all the said parties to these presents that before the end of the next Provincial Court one or more writ of writs of Entry Sur disseisin en le post at the Cost and Charges of the said John Frederick Augustus Priggs and Sarah his wife shall and may be brought and prosecuted against him the said Henry Brookes in the name of him the said John Rogers as plaintiff or Demandant therein of and for the aforesaid Several tracts and parcells of Land with the Appurtenances by such name or names quantity quality number or Content of Acres or Other certainties and discriptions as shall be Apt and Convenient in that behalf to which writ or writs the said Henry Brookes shall appear gratis in his proper person or by his Attorney or Attornies lawfully Authorized and shall vouch to warrant the premisses the aforesaid John Frederick Augustus Priggs and Sarah his wife who shall likewise appear gratis in their proper persons or by their Attorney or Attornies lawfully Authorized and shall and will enter into the said warranty and vouch over to warrant the same premisses the Common Vouchee who shall thereupon appear and enter into the said warranty and after Imparlance make default and such further and Other proceedings shall be therein so that one or good and perfect Common recovery or recoveries with double voucher shall and may be had Suffered perfected and executed in all things according to the usual form of common Recoveries with double voucher for Assurance of Lands in such Cases used and Accustomed and it is hereby further Covenanted Concluded (declared) |
